RESOLUTION 12-215
A RESOLUTION ADOPTING A FINAL ASSESSMENT SCHEDULE FOR THE 2011
SIDEWALK IMPROVEMENT PROGRAM PHASE II AND CONFIRMING AND
LEVYING ASSESSMENTS,STATING THE NUMBER OF ANNUAL INSTALLMENTS
AND SETTING INTEREST ON UNPAID INSTALLMENTS AND SETTING THE TIME
WHEN ASSESSMENTS ARE DUE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee moved forward with the assessment proceedings in connection
with the 2011 sidewalk program Phase II;AND,
WHEREAS,the City of Waukee requested Veenstra &Ki111m,Inc.to provide professional
engineering services on the project;AND,
WHEREAS,the work for which assessments are being levied was accepted by the Council on
October 1",2012;AND
WHEREAS,the engineer has filed the assessment schedule as required by Iowa Code §384.59
which was been received and filed on the 28th day of September,2012;AND,
WHEREAS,Iowa Code §384.60 requires the Council to take certain action upon the filing of
said assessment schedule and the Council,having first considering the engineer's assessment
schedule,deems it appropriate to adopt the assessment schedule as filed.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
1st day of October,2012 that it hereby confirms and levies the Assessments against the properties
in the amounts set forth in the Engineer's Assessment schedule prepared and filed in accordance
with Iowa Code §384.59.There are $0.00 of deficiencies that may be subsequently assessed
against each lot.
BE IT FURTHER RESOLVED that the assessments shall be divided into Ten (10)annual
installments and unpaid installments shall bear interest at the rate of 3 %per annum commencing
October 1,2012.
BE IT FURTHER RESOLVED that the first installment of each assessment,or the total
amount if less than one hundred dollars,is due and payable on July I st of each year the first
instalhnent due and payable on July 1,2013.The first installment shall bear interest on the
whole unpaid assessment from October 1,2012 to December 1,2013.The succeeding annual
installments,with interest on the whole unpaid amount,to the first day of December following
the due date,are respectively due on July 1sl annually,and must be paid at the same time and in
the same manner as the September semiannual payment of ordinary taxes and as otherwise
provided pursuant to Iowa Code Section 384.65.

BE IT FURTHER RESOLVED the City Clerk shall certify the final schedule to the Dallas
County Treasurer and publish notice of the schedule once each week for two consecutive weeks
in the manner provided in Section 362.3 Iowa Code (2009),the first publication of which shall
be not more than fifteen days from the date of filing of the final schedule and send the notice to
the affected property owners in the manner prescribed by Iowa Code Section 384.60.
Passed by the City Council of the City of Waukee,Iowa,and approved this the 1st day of
October,2012.
