RESOLUTION 12-235
APPROVING THE EXTENSION OF EXISTING LEASE/PURCHASE AGREEMENT WITH
THE METRO WASTE AUTHORITY FOR THE METROPOLITAN
SALT STORAGE FACILITY
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,on September 5,2008,the Metro Waste Authority (MWA)and the Cities of Waukee,
West Des Moines,Urbandale,J olmston,Clive,Windsor Heights,Grimes,Des Moines and Pleasant
Hill entered into a 28E Agreement for the Lease Purchase of a Metropolitan Salt Storage Facility on
Metro Waste Authority Property (hereinafter referred to as the "28E Agreement")(Waukee Resolution
#08-128);AND
WHEREAS,the original term of the 28E Agreement commenced on September 5,2008,and
continues until June 30,2013;AND,
WHEREAS,the 28E Agreement may be extended by the Cities through June 30,2028,allowing the
Cities to leave the building in place,unless the MW A has given notice between 20 and 24 months prior
to the expiration of the original term of the lease terminating on June 30,2013;AND,
WHEREAS,the Agreement provides the Cities the option to extend the 28E Agreement following the
original term if the Cities give written notice 20 to 24 months prior to the expiration of the original
term;AND,
WHEREAS,the City of Waukee desires to extend the 28E Agreement following the original terms of
the Lease;AND,
WHEREAS,after 2013,any City may withdraw from the 28E Agreement by giving one (1)year's
notice to the other Cities ofthe proposed withdrawal.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this nnd
day of October,2012,that it hereby gives notice pursuant to Section 3.01(B)of the 28E Agreement for
the Lease Purcbase of a Metropolitan Salt Storage Facility on Metro Waste Authority Property that it
desires to extend the Agreement with copies to the MW A and member COl1ll .ties.
