RESOLUTION 12-269
APPROVING SETTLEMENT CONCERNING
EMERALD POINTE CONDOMINIUMS HOMEOWNERS ASSOCIATION
INTHENAMEANDBYTHEAUTHORITYOFTHECITYOFWAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized
Municipal Organization;AND,
WHEREAS,legal counsel for the City of Waukee and the Emerald Pointe Condominiums
Homeowners Association have been in negotiations related to storm sewer drainage from the
Emerald Pointe Condominiums property;AND,
WHEREAS,City of Waukee legal counsel recommends approval of a settlement agreement
concerning the matter.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council that the
proposed settlement with the Emerald Pointe Condominiums Homeowners Association is
approved.
Passed by the City Council of the City of Waukee,Iowa,and approved this the 3'-d day of
December,2012.
