RESOLUTION 12-283
APPROVING THE FINAL PLAT FOR FOX CREEK ESTATES PLAT 3
IN THE NAME AND BY THE AUTHORiTY OF THE CITY OF WA UKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,PERFECT ACRES,L.L.C.(the "Developer")has requested final approval of Fox
Creek Estates Plat 3 (the "Plat");AND
WHEREAS,the City of Waukee Planning and Zoning Commission recommended approval of
the Plat on December 11,2012;AND,
WHEREAS,the Final Plat for Fox Creek Estates Plat 3 and the documents relating thereto
comply in all respects with Section §303 -Land Subdivision Ordinance of the Waukee
Municipal Code;AND,
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,Iowa
on this lih day of December,2012 that the Final Plat for Fox Creek Estates Plat 3 be and the
same is hereby accepted and approved by the City Council of the City of Waukee subject to final
review and approval of the legal docmnents by the City Attorney.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following
additional easements and documents to be filed with the Plat:
1.Warranty Deed for Lots A-C and Outlot Z;
2.Storm Sewer Easement;
3.Public Utility Easement;
4.Public Landscape Buffer Easement;
5.Public Overland Flowage Easement;
6.Public Snow Storage Easement;
7.Public Sanitary Sewer Easement;
8.Storm Water Detention Easement;
9.Temporary Overland Flowage Easement;
10.Temporary Water Main Easement;
11.Temporary Turnaround Easement;
12.Temporary Sediment Basin Easement;
13.Storm Water Management Facility Maintenance Covenant and Permanent
Easement Agreement;
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file the
final plat of Fox Creek Estates Plat 3,as well as any other documents related thereto,with the
Dallas County Recorder.
