WHEREAS,the exists a gravel road -that does not exist as an easement or
ROW,that is commonly referred to as N.6th Street;and
WHEREAS,it appears that the former City Council in the early 1990's
approved moving forward with accepting a ROW known as N.6th Street but
that,process was never completed;and
WHEREAS,the City of Waukee has underground utilities under portions of
what is known as N.6th Street without appropriate easements;and
WHEREAS,until recently,the City had maintained this drive,even though
it was not a public street -for a period of at least four (4)years;and
WHEREAS,it is not City policy to accept private roads that do not meet the
City's minimum standards,but that in this case special circumstances exist
that make it in the best public interest to accept such deeds,
NOW THEREFORE BE IT RESOLVED,that the City proceed with the
acceptance of deeds to what is known as N.6th Street,and all the other
required utility easements that were never filed,and in doing so make N.6th
Street a public road.And be it further resolved that with these deeds the City
makes no promise not to special assess for pavement in the future,and that
the acceptance of these easements will include the City's maintenance of said
road.
