RESOLUTION 13-081
APPROVING THE SALE OF REAL PROPERTY LEGALLY DESCRIBED AS 14675 SE
UNIVERSITY AVENUE AND AUTHORIZING THE MAYOR TO SIGN DOCUMENTS ON
BEHALF OF THE CITY OF WAUKEE RELATED TO THE SALE OF SAID PROPERTY
IN THE NAME AND BY THE AUTHORiTY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,on September 17,2012,the Waukee City Council directed City staff to pursue the sale of
city-owned property legally described as 14675 SE University Avenue,Waukee,Iowa (Resolution
#12-206);AND,
WHEREAS,pursuant to Iowa Code §364.7,notice was published that October 10,2012,at 2:00 p.m.
at Waukee City Hall would be the date,time and place for receipt of bids for said property;and that
October 15,2012 at 5:30 p.m.at Waukee City Hall Council Chambers would be the date,time and
place for public hearing on the proposal;AND;
WHEREAS,the City Council chose not to accept the highest bid in the amount of$15,000 and
continue to pursue the sale of the property;AND,
WHEREAS,the City has received a bid in the amount of $18,000 from RM.Madden Construction,
Inc.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 15'h
day of April,2013,that it hereby approves the sale of property legally described as 14675 SE
University Avenue to RM.Madden Construction,Inc.,5909 Grand Avenue,Des Moines,IA 50312,in
the amount of$18,000.00,subject to the buyer submitting a 10%bid security within 20 days of City
Council approval.
BE IT }<'URTHERRESOLVED by the City of Waukee City Council that it hereby authorizes Mayor
William F.Peard to sigu any and all documents on behalf of the City of Waukee as they relate to the
sale of property legally described as 14675 SE University Avenue.
