RESOLUTION 16-492
APPROVING AMENDED AND SUBSTITUTED PETITION,CONTRACT AND
WAIVER —LANDING AT SHADOW CREEK PLAT 4
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF IYA UKEE,IO le
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City of Waukee has previously approved a final plat for Landing at Shadow
Creek Plat 4 which included a Petition,Contract and Waiver related to future improvements
associated with Alice's Road widening;AND,
WHEREAS,said Petition,Contract and Waiver was recorded on October 11,2016 in Book
2016 at Page 19693 in the office of the Recorder for Dallas County,Iowa;AND,
WHEREAS,the City of Waukee and the developer,Landing at Shadow Creek,LLC desire to
amend and substitute the original agreement to encumber only lots 33-36 of Landing at Shadow
Creek Plat 4.
NOW THEREFORE BK IT RESOLVED by the City Council of the City of Waukee,Iowa on
this the 21"day of November,2016,that the Amended and Substituted Petition,Contract and
Waiver for the Landing at Shadow Creek Plat 4 be approved.
