HomeMy WebLinkAbout2017-12-04-Resolutions 17-562_Alice's Rd Corridor Phase 4 - Engineering Agr Amendment 1THE CITY OF WAUKEE,IOWA RESOLUTION 17-562 APPROVING ENGINEERING SERVICES AMENDMENT NO.1 BETWEEN THE CITY OF WAUKEE AND FOTH INFRASTRUCTURE AND ENVIRONMENT,LLC [ALICE'S ROAD CORRIDOR IMPROVEMENTS PHASE 4] IN THE NAMEAND BYTHEAUTHORITYOF THE CITY OF WAUKEE,IOUS WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal Organization;AND, WHEREAS,on July 18,2016,the Waukee City Council approved an Agreement for Professional Consulting Services with Foth Infrastructure &Enviroiunent,LLC [Reconstruction Design Services, SE Alice's Road North of University Avenue to North of SE Olson Drive (Phase 4)](Resolution ¹16- 307);AND, WHEREAS,Foth Infrastructure &Environment,LLC,has submitted Amendment No.I to the agreement for additional services associated with project coordination,design services,and final plan modifications related to adjacent development agreements;and construction administration for the second construction season;AND, WHEREAS,the engineering services agreement has been reviewed and approved by the Waukee City Attorney. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the Engineering Services Amendment No.I between the City of Waukee and Foth Infrastructure and Environment,LLC [Alice's Road Corridor Improvements Phase 4],attached hereto as Exhibit A,is hereby approved. Task A.1 Exhibit Pre aration Exhibits for the project meetings consisted of aerial mosaics for the project with the major project features indicated on the aerial photograph.Include coloring,lettering,and other techniques to delineate the proposed design concepts and right of-way needs,including typical sections of the roadway.The figure indicated right-of-way needs,property lines,property ownership,access control lines,grading limits,and new project improvements. Task A.2 Pro'ect Coordination with Ad'scent Landowner's En ineerin Consultant The Engineer conducted meetings to address specific conflicts and concerns.Two (2)meeting(s)were held with representatives of the adjacent Landowner.The first was to advise of the nature and extent of the improvements and any potential conflicts with existing or proposed utility systems,and the second addressed preliminary/final design review and coordination meetings. Task A Subtotal -$1 200000 TASK B —Additional Design Services to incorporate adjacent Development Agreements After SE Alice's Rd was designed the following items were requested by adjacent property owners: Task B1 Additional To o ra hie Surve The Consultant performed the following additional topographic surveys to determine the amount of additional earthwork needed and roadway tie in elevations.This information was used to develop the existing ground DTM for the Project site. ~Properties adjacent to the proposed Future Rd:Gilcrest/Jewett,S&P Properttes,and DJN,LLC. Task B 2 Additional Plattin Services Prepared acquisition plats and legal descriptions for property to be acquired for the Project and perform land corner and lot surveys as needed for the preparation of the acquisition plate and legal descriptions for each parcel.Said plats and legal descriptions shall comply with requirements of the lowe Code and shall be prepared by or under the direct supervision of a licensed land surveyor under the laws of the State of Iowa.The following numbers of plate are assumed: Page 1 Fath Infrastructure and Environment,Ll 0 Project Number 16W021.01 8E Alices Road North of University Avenue to North of Dison Drive IPhase S) Waukee,lowe Permanent (Fee Title)Right-of-Way Acquisition Plat Temporary Construction Easement Permanent Easements Sanitary Sewer Easement Water Main Easement Storm Sewer Easement Overland Flowage Easement Public Facilities and Use Easement Task B Subtotal -$8,000.00 TASK C —Final Plans Modifications for adjacent Development Agreements Based upon the approved revised preliminary design,field review,and property owner review,the Consultant subsequently proceeded with final design,contract drawings,specifications and opinion of probably construction costs for the plan revision for the construction of the Future Road Extension improvements. Task C Subtotal -$10,000.00 II.Construction Services TASK A —ADDITIONAL CONSTRUCTION ADMINISTRATION The original Agreement assumed one construction project estimated to be 18hrs/week of effort during the 2017 construction season.Currently the project being constructed will require construction Administration Services during the 2018 construction season and final project close out in mid-2018. Additional Construction Administration efforts over and beyond the original effort includes additional field visits, construction meetings,processing of pay vouchers,daily communication and modification of construction documents .The following assumptions are included: ~Average 12hrs/week beginning in the Winter of 2017 thru Spting 2018 Note —hours were reduced during winter shut down Task A Subtotal -$13,000.00 In consideration for these services,the City agrees to adjust the Contract Schedule for services performed by the Consultant under this Contract Amendment of the original project. These fees are based on the standard hourly rates of the Consultant's personnel actually engaged in the pert'ormance of the services,plus direct out-of-pocket costs for expenses incurred by personnel who are actually engaged in the work and other direct costs.The total Hourly Not-to-Exceed fees for the professional engineering services as described in this amendment are as follows: I.Basic Services of the Consultant Task A $12,000.00 Task B $8,000.00 Task E 10 000.00 Total $30,000.00 IL Resident Consultant Services Task A $13,000.00 THIS AMENDMENT is subject to all provisions of the original Agreement. THIS AMENDMENT,together with the original Agreement represents the entire and integrated AGREEMENT between the City and Consultant. THIS AMENDMENT executed the day and year written above.
