APPROVING PURCHASE AGRKEMKNT RELATED TO ALICE'S ROAD
CORRIDOR IMPROVEMENTS,PHASE 5 [UNIVERSITY OF IOWA COMMUNITY
CREDIT UNION]
IN THE NAMEAND BY THE AUTHORITY OF THE CITY OF WAUKEE,IONA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,it has been determined that the purchase of certain property for rights-of-way is
necessary for the purpose of construction of the Alice's Road Corridor Improvement Project,
Phase 5 (the "Project");AND,
WHEREAS,certain rights-of-way shall be located on a portion of the property owned by
University of Iowa Community Credit Union and legally described as referenced in Exhibit A,
which is attached hereto.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
21"day of August,2017,that it hereby approves the Purchase Agreement related to Alice's
Road Corridor Improvement Project,Phase 5,with payment made by the City to property
owner(s)University of Iowa Community Credit Union in the amount of $141,150.

Ib Said Temporary Construction Easement shall terminate upon completion of the construction of this project and acceptance of the
project by the City Council or 24 months,whichever occurs first.SELLER ACKNOWLEDGES full settlement and payment from
Buyer for aU clanns per the terms of this agreement and dischar es Buyer from liability because oF this agreement nnd the
construction ot'this public improvement project.except that Seller reserves any claim for any damages to the property during
construction.The premises being purchased in fee also mcludes aU estates.rights.title and interests,includin aU easements,and
all adveuising devices.
7.possession of the premises is the essence of this agreement and Buyer may enter and assume full use and enjoyment of the
premises per the terms of this a reement.SELLER GRANTS Buyer the immediate righl to enter the premises for the purpose of
gathenng survey and soil data.SFLLFR MAY surrender possession of the premises or building or improvement or any part
thereof prior to the tim"at which he has hereinafter a reed to do so,end agrees to give Buyer ten (IO}days notice of Seller's
intention to do so by calling Buyer collect.
Buyer agrees to pay and SELLER A(}REES to grant the rirbt of possession,convey tiile and surre ader physical possession of the
premises as shown on or before the dates listed below.
