RESOLUTION 17-574
APPROVING WATER MAIN EASEMENT(S)RELATED TO THE WACO PLACK
WATER MAIN EXTENSION PROJECT [RICHARD JAMES VOGEL AND CAROL
LYON VOGEL]
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UICEE,IOP'A
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,it has been determined that a Water Main Easement is necessary for the purpose of
construction of the Waco Place Water Main Extension Project;AND,
WHEREAS,said easement shall be located on a portion of the property owned by Richard
James Vogel and Carol Lyon Vogel and legally described as referenced in Exhibit A,Easement
Area,of the Water Main Easement(s),which is attached hereto.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
18'"day of December,2017,that it hereby approves the Water Main Easement(s)related to the
Waco Place Water Main Extension Project [Richard James Vogel and Carol L on Vogel]in the
amount of $L00.

(including&thc right to place and build adtlitional '&gati;I'&Main therein or to connect &ilid,'or join the
Water Main and appurtenances thereto)and to forever maintain theWatcr Ivlain «hcnctcr
necessary v ithin the Easement(s)granted Itcrcin.x&'o structure or building of'any kind «hatsocvcl
shall be erected upon property that is the subject.of this Easement ivithout the express «ritten
consent of the City.The temporary casement shall be I'or a 12 month period,or until the end ol'
construction,at vvhich time said temporary «ill cease and terminate.
3.Maintenance,
After the initial construction oF the V''atcr iX'lain&and acceptance by the City,thc City
agrees,as part of the reconstruction,maintenance and patrolling ol the '&Vater Main.to resturc and
replace the Easement area(s)to substantially the same comlition as prior to the time ol entry or as
ag&reed upon by the City and the Grantor(a),except the City shall not be required to replace
landscaping.trees,shrubs.bushes,landscape elements,structures,or underground water systems
nor shall the City be required to restore the Easement area by reason of settlemenh depression,or
any unknown conditions vvhich arise subsequent io the restoration and/or replacing ot'the
easement area;any subsequent restoration bv reason of settlement,dcprcssiolt or ally Llllkltowll
conditions shall be thc sole responsibility of the Grantor(s)at the Grantor(s)'sole expense.
4.Ri &ht ol'Access.
The City shall have the right of access to the Easement Area &ind have all rights ol'ingress
and egress reasonably necessary for the use and enjoyment of'the Eas&unent Area as hereili
described,includin&g,but not limited to,the right to rt:move &uty unauthorized obstructions or
structures placed or erected in the Easemcnt Area.
5.I-told Harmless,
The Grantor(s)agrees to indemnify and hold harmless the City,its elected ollicials.
etttployees.officers,agents,representatives,contractors.and attorneys from &uid against any and
all claims or demands I'or liability&loss.damage.costs.expenses,or attorney's fees of any kin i ri&r
actions or omissions of the Grantor(s)arising out ol'or in connection «ith any undertalcin&&arisin&&
out,of or othervvise related to this Eascmcnt.
6.Runnin&&of l)eneftts and lgurdens.
The terms and conditions of this Easement arc binding upon the Gramor including.but flot
limited to,future oivners&tlcvclopcrs.lessees or occupants.All provisions of this instrumi:nt,
including benefits and burdens.run «ith the land and arc binding upon and inure to the heirs.
assigns.successors,tenants and personal rcprescntatitcs oF the parties hereto.
7.Jurisdiction and Vcnuc.

9 Parties.
The term "City"as usccl herein shall rcfi;r lo the City of Waulcee.Ioiva.iis ele«led ol'I icials,
agents,employees,oflicers,and contractors.'I'hc term "Grantor(s)"shall refer to Richard James
Vo el and Carol I von Vooel&their heirs,&assigns,successors-in-interest,or lessees.if any.
10.Attornev's Fees.
The City may enforce this instrument by appropriate action,;usd should they prevail in such
litigation they shall recover as part oF their costs the reasonable attorney's 1'ecs incurred in such
litigation.
This Agreement shall constitute the entire Ag&reement betvveen the partie and no
amettdmcnts or additions to this Agreement shall be bincli&1g iii11css in tvriting and signeci by both
parties.
