APPROVING WATER MAIN EASEMKNT(S)RELATED TO THK WATER MAIN
EASEMENT(S)RELATED TO THE NORTHWEST AREA WATER MAIN
EXTENSION PHASE 1 PROJECT [LEACH FAMILY FARMS,INC.]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WA UKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,it has been determined that a Water Main Easement is necessary for the purpose of
construction of the Northwest Area Water Main Extension Phase 1 Project;AND,
WHEREAS,said easement shall be located on a portion of the property owned by Leach Family
Farms,Inc.,and legally described as referenced in Exhibit A,Easement Area,of the Water Main
Easement(s)which is attached hereto.
NOW THEREFORE BK IT RESOLVED by the City of Waukee City Council in session this
2""day of January,2018,that it hereby approves the Water Main Easement(s)related to the
Northwest Area Water Main Extension Phase 1 Project [Leach Family Farms,Inc.]in the
amount of $8,059,16.

Eascmcnt area(s)to substantiallv the same condition as prior to the time of entry or as agreed upon
by thc City and the Grantor(s).except the City shall not be required tr&replace landscaping,trccs.
shrubs.bushes,landsc:ape elements,structures,or unclerground water systems nor shall the City bc
required to restore the Easement area by reason of settlemcnt.depression.or any unknown
conditions vvhich arise subsequent to the restoration and/or replacing of the easement area:any
subsequent restoration hy reason of'settlement.depression or any unknown conditions shall bc the
sole responsibility ol'the Grantor(s)at the Cirantor(s)'sole expense.
4.Rieht ol'Access.
Thc City shall have the right ol'access to the Easement Area and have all rig&his ol'inaress
and cgrcss reasonably necessary for thc usc encl errjoyment of the Easement Area as herein
describecl.including&.but not limite&f to.thc right to remove any unauthorixcd obstructions or
structures placed or erected in the Easement Area.

includin&'benefits and burdens.rim with the land anti are bindin«upon and inure to the heirs,
assigns.successors.tenants and personal representatives ol'thc parties hereto.
7..lurisdiction and Venue.
Th«City and lhe Grantor(s)agl'cc dlc District Court of thc State of Iowa shall have
exclusive jurisdiction over the subject matter and enlorcement of the terms and conditions of this

The City may enforce this instrument by appropriate action,and should they prevail in such
