RESOLUTION 18-098
APPROVING THK VACATION OF A PORTION OF A STORM WATER
MANAGEMENT FACILITY MAINTENANCE COVENANT AND PERMANENT
EASEMENT AGREEMENT ACROSS THE SHOPS AT KETTLESTONK NORTH
PLAT 1
IN THE NAME AND BY THEA UTHORITY OF THE CITY OF WA USE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City has previously approved a final plat for The Shops at Kettlestone North
Plat I,which included a Storm Water Management Facility Maintenance Covenant and
Permanent Easement Agreement recorded in Book 2017 Page 5162 (the "Easement");AND,
WHEREAS,it has been determined that a portion of the Easement as described on attached
Exhibit A is no longer needed;AND,
WHEREAS,the property owner has requested that the easement as described in attached
Exhibit A be vacated.
NOW THEREFORE BK IT RESOLVED by the City of Waukee City Council in session this
19'"day of March 2018,that it hereby approves the vacation of a portion of the Storm Water
Management Facility Maintenance Covenant and Permanent Easement Agreem across a
portion of The Shops at Kettlestone North Plat l.
