RESOLUTION 18-123
APPROVING THK SETTLEMENT AGREEMENT AND EASEMENTS BETWEEN
BRODERICK FAMILY,L.P.AND THE CITY OF WAUKEK
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,the City has been in discussion with Broderick Family,L.P.regarding the
conveyance of certain property interests necessary including crop and tree loss for the Little
Walnut Creek Trunk Sewer —Phase 3/Indi Run Trunk Sewer Project in Waukee;AND
WHEREAS,the discussions have resulted in a settlement agreement and easements,and the City
Staff believes it is in the best interest to approve said settlement agreement and easements.
NOW THEREFORE BK IT RESOLVED by the City Council of the City of Waukee,Iowa,that
the settlement agreement and easements between Broderick Family,L.P.and the City of Waukee
are hereby approved.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute any and all documents
to effectuate the closing on behalf of the City,and that the City Clerk shall cause the originals to
be recorded upon the properties by submitting the original to the Dallas County Recorder with
the appropriate recording fees.
Passed by the City Council of the City of Waukee,Iowa,and approv this the 27'"day of
