RESOLUTION 18-203
ESTABLISHING A WEIGHT LIMIT ON 8 STREET FROM ASHWORTH DRIVE TO
CHERRY STREET
IN THE NAMEAND BY THEAUTHORITYOF THE CITY OF WAUICEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,heavy construction traffic is occurring on 8"Street causing premature deterioration
and posing a threat to safety;AND
WHEREAS,pursuant to Iowa Code 321.473 the City Council has the authority to establish
weight restrictions on City Streets;AND
WHEREAS,public works and the city engineer have reviewed the area and the streets
characteristics and recommended the City Council establish a weight restriction of 5 tons for
trucks utilizing 8 Street.
NOW,THEREFORE,BE IT RESOLVED that pursuant to section 501.28 of the Waukee
Municipal Code and Iowa Code 321.473 (2018),the City Council of the City of Waukee hereby
prohibits trucks weighing in excess of 5 tons from operating on 8 Street from Ashworth Drive
to Cherry Street.As provided in Iowa Code 321.473,a violation of this resolution shall be
subject to a fine determined by dividing the difference between the actual weight and the
maximum weight established by the ordinance or resolution by one hundred,and multiplying the
quotient by two dollars.
Passed by the City Council of the City of Waukee,Iowa,and approved this the 2 ay of May,
2018.
