RESOLUTION 18-407
APPROVING PARTIAL SATISFACTION OF AMENDED AND RESTATED
DEVELOPMENT AGREEMENT AMONG THE CITY OF WAUKEK AND ALICKS
L.C.AND TEAM DKS MOINES PARTNERS,LLC
IN THE NAMEAND BY THEAUTHORITYOF THE CITYOF WAUI EE,IOS'A
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized
Municipal Organization;AND,
WHEREAS,Alice's,L.C and Team Des Moines Partners,LLC.entered into a Development
Agreement dated August 6,2007,as amended by an Amendment to Development Agreement
dated July 21,2008,then replaced by an Amended and Restated Development Agreement
dated March 19,2012 and then amended by an Amendment No.I to Amended and Restated
Development Agreement dated October 6,2014 as recorded in Book 2014 Page 14153 in the
office of the Recorder of Dallas County,Iowa;and
WHEREAS,the agreement encumbers a portion land that is no longer subject to the
agreements and the City desires to partially release the land that is no longer subject to the
agreement.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee,Iowa
that the City does hereby release the encumbrance arising by virtue Alice's,L.C and Team
Des Moines Partners,LLC.entered into a Development Agreement dated August 6,2007,as
amended by an Amendment to Development Agreement dated July 21,2008,then replaced by
an Amended and Restated Development Agreement dated March 19,2012 and then amended
by an Amendment No.I to Amended and Restated Development Agreement dated October 6,
2014 as recorded in Book 2014 Page 14153 in the office of the Recorder of Dallas County,
Iowa on only the following property:
PARCEL 18-134 OF THE SURVEY OF PART OF OUTLOT Y IN PRAIRIE
CROSSING PLAT 3,AN OFFICIAL PLAT,NOW INCLUDED IN AND
FORMING A PART OF THE CITY OF WAUKEE,DALLAS COUNTY,IOWA,
AS SHOWN IN BOOK 2018,PAGE 18245 IN THE OFFICE OF THE
RECORDER OF DALLAS COUNTY,IOWA.
Passed by the City Council of the City of Waukee,Iowa,and approved this the 8th day of
October,2018.
