RESOLUTION 18-260
APPROVING A MEMORANDUM OF UNDERSTANDING WITH COMMUNICATIONS
WORKERS OF AMERICA (CWA),LOCAL ¹7102,AFL-CIO,AS PART OF THE JULY 1,
2016 —JUNE 30,2021 CONTRACT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WA UKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,on May 23,2016,the Waukee City Council approved a Collective Bargaining
Agreement with the Communications Workers of America (CWA),Local ¹7102,AFL-CIO,in effect
July I,2016 through June 30,2021 (Resolution ¹16-219);AND,
WHEREAS,the City of Waukee and representatives of CWA,Local ¹7102,have reviewed and
approve a Memorandum of Understanding which modifies the pay rates for three Public Works
Department employees and places them in newly created open positions;AND;
WHEREAS,the Memorandum of Understanding is attached hereto and by reference incorporated
herein;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 2"day
of July,2018,that the Memorandum of Understanding with Communications Workers of America
(CWA),Local ¹7102,AFL-CIO,as part of the July 1,2016 —June 30,2021 contract is hereby
approved.

This Memorandum of Understanding ("Memo")is entcrcd into on this 28a day of June 2018,by and between
the City of Wsukee,lowe ("City")snd the Communications Workers of America,Local 7102,AFI CIO ("Union"),
WHEREAS,City and Union entered inta a collective bargaining agteement for the period of July 1,2016,
through June 30,2021,"(the "CoutracC);and
WHEREAS,the Contract governs certain conditions ol'employment for members of the Union wbo are
employed by City,and
WHEREAS,&is Memo identifies an agreement betweeu the parties to allow certain employees to accept
vacant positions while maintaining their current wage rate through the end of the current contract;and
IT IS THEREFORE ACiREED,by and between City aud Union as follows;
A.The City plans to eliminate the following positions eft'ective July 1,2018:
1.Senior Engineering Tecluucian —Tony Benson's current position;
2.Stormwater Coordinator —Jenny Corkresn's current position,'and
3.Maintenance Mechanic —Oren Peterson's cunent position.
B.Effective July 1,2018,the City will look to lure an additional person for each of the fnllowing jobs:
1.Engineering Teohnician;
2.Storrnwater Inspector;and
3.Equipment Services Technician
C,The parties have agreed that —'instead of posting the vacant positions —since the above-referenced
employees me already performing the duties of the vacant positions,they will be placed into the vacant
positions and onto the appropriate wage scale for those vacant positions;however,the City agrees to
keep the above-referenced employees'wages the same ss they are as of July 1,2018,through the end of
the current contract —which wou!6 result in the following hourly wages fram July I,2018,through June
30,2021:

2.Jeiuiy Corkrean -$36,36 per hour;aud
3,Oren Peterson -$36.36 per hour.
D,The undersigned acknowledge and represent that they are authorized to enter into this Agreement and
tlmt tlic terms and conditions are bhiding upon the panies,their officers,menibers,successors and
assigns.
E.This iuterpretation shall be effective upon the execution of this Memo.Thc parties agree that this Memo
has no precedential value snd shall not be used as evidence ol past pracnce in the future
