APPROVING PUBLIC WATER MAIN EASKMKNT(S)FOR THE WAUKKK HIGH
SCHOOL NO.2 PROJECT [PHILIP E.BRODERICK REVOCABLE TRUST AND
CHARLOTTE R.BRODKRICK REVOCABLE TRUST]
IN THE NAME AND BY THEAUTHORITYOF THE CITYOF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,it has been determined that Public Water Main Easement(s)are necessary for the
purpose of construction of the Waukee High School No.2 Project;AND,
WHEREAS,said easements shall be located on a portion of the property owned by Philip E.
Broderick Revocable Trust and Charlotte R.Broderick Revocable Trust,and legally described as
referenced in Exhibit A,Easement Area,of the Public Water Main Easement(s),which is
attached hereto.
NOW THEREFORE BK IT RESOLVED by the City of Waukee City Council in session this
1"day of October,2018,that it hereby approves the Public Water Main Easement(s)for the
Waukee High School No.2 Project [Philip E.Broderick Revocable Trust and Charlotte R.
Broderick Revocable Trust]in the amount of $L00.

in consideration of thc sum of One Dollar ($1.00)and other good and valuable consideration.the
receipt and sufticiency ol vvhich is hereby acknowledged,does hereby sell&grant,and convey to
thc CITV Olt'WAUKI;K,IOWA,a municipal corporation (hcrcinafter referred to as "ihc
City"),a permanent and perpetual eascmcnt (hereinafter referred to as "Easement")and right-olt
way upon.over,under,through and across the real property legally described as:

(hereinafter rel'erred to as the "Easement Arcs")for the purpose of locating and maintaining a

and allow the City io enter at any time upon,over,uncler,through,and across into ihe Easement
Area herein described to use as much of the surface and sub-surface thereof'to construct,replace.
locate,rebuild&enlarge.reconstruct,patrol.repair (including the right io place and build
additional Water Main therein)and to forever maintain the Easement whenever necessary within
thc Eascnlcni Al'ca.
'I'his Easemeni slmll be subject 0&the following&terms and conditions:
Erection of Structures Prohibited Gl'ajltol'and its successors and assigns shall not erect

consent of the Citv.
2.Maintenance.Alter ihe initial construction of the Water Main,and acceptance bv the
City.the ('iiy agrees,as part ol'thc reconstruction,maintenance and patrolling of the Water Main,
to restore and replace the Fasement Area to subsiajltially the same condition as prior io ihe time
of cnu'y oj'tls algl'eed upon by the City and the Grantor.except the City shall noi be required to
replace landscaping,trees.shrubs,bushes,landscape elements,structures,or under&&rountf water
systems nor shall the City be required to restore the Fasement Area by reason of settlement,
dcpircssion,or any unknown conditions which arise subsequent to the restoration and!or replacing
of the Easement Area.Any subsequmtt reaioration by reason of settlement,depression or any
uf'Ikno1vn conditions shall bc thc sole responsibility ol the Grantor at the Grantor's sole expense.
3.Chanoe in Grade Prohibited.Grantor anil its successors and assigns shall not change thc
grade elevation or contour of any part of the Easement Area 11ithout obt&aining the prior Svritten

Area as herein described.including,but not limited to.ihc right to remove any unatrthorized
obstructions or structures placed or erected in thc Fasement Area.

5.Easement Runs With Land.This Easement shall be deemed to run lvith the land and shall
be binding on Glrantor and on Grantor's hells.stlcccssol's and llsslgns.
6.Jurisdiction and Venue.The City and the Grantor agree the District Coun in and for the
State oi'Iowa shall have exclusive jurisdiction over the subject matter and enforcement of the
terms and conditions of this Easement and said parties consent to the jurisdiction of the person
being in Dallas County,Iowa.
Grantor does I-IFREBY COVI'NANI'with the City that (i)Grantor holds said real estate
described in this Easement Area by title in fee simple,(ii)that Grantor has good and lawful
mlthority to convey thc same:and (iii)said Grantor covenants to tVARRANT AND DEFL'ND
the said Easement Area against the claims of all persons whomsoever.
Words and phrases herein,including acknowledgment hereof,shall be construed as in the
singulm'or plural number,and as masculine or feminine gender,according to the context.
