RESOLUTION 18-485
APPROVING ENGINEERING SERVICES AMENDMENT NO.2 BETWEEN THE CITY OF
WAUKEE AND FOTH INFRASTRUCTURE AND ENVIRONMENT,LLC [ALICE'S ROAD
CORRIDOR PROJECT PHASE 4]
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA USE,10WA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,on July 18,2016,the Waukee City Council approved an Agreement for Professional
Consulting Services with Foth Infrastructure &Environment,LLC [Reconstruction Design Services,
SE Alice's Road North of University Avenue to North of SE Olson Drive (Phase 4)](Resolution ¹16-
307);AND,
WHEREAS,on December 4,2017,the Waukee City Council Approved Amendment No.I to the
Agreement for Professional Consulting Services (Resolution ¹17-562);AND,
WHEREAS,Foth Infrastructure &Environment,LLC,has submitted Amendment No.2 to the
agreement for additional services including field visits,construction meetings,processing of pay
vouchers,daily communication,and modification of construction documents;AND,
WHEREAS,the City Attorney has reviewed the proposed amendment and finds it satisfactory.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Engineering Services Amendment No.2 between the City of Waukee and Foth Infrastructure and
Environment,LLC [Alice's Road Corridor Improvements Phase 4],attached hereto as Exhibit A,is
hereby approved.

the CITY OF WAUKEE,IOWA,hereinafter referred to as the "City",and FOTH INFRASTRUCTURE AND
ENVIRONMENT,LLC.,hereinafter referred to as the "Consultant",for professional services in connection with the
relimina surve and ma in functional desi n ro ect coordination relimina desi n final lans and
s ecifications for the ra used construction of SE Alices Road from North of Universit Avenue ta North of Glean Drive
~Phase 4 hereby amends the original Agreement dated June 20th,2016 as follows:
The City and Consultant agree to amend the original Agreement to include additional services associated with:
~Construction Administration for Contractor working thru Fall 2018
II.Construction Services
TASK A —ADDITIONAL CONSTRUCTION ADMINISTRATION
The original Agreement assumed one construction project estimated to be 16hrs /week of effort duding the 2017
construction season.Amendment 1 assumed an extension thru May 2018 averaging 12hrs/week with reduced
hours during winter months.Currently the project being constructed will require construction Administration
Services during the entire 2018 construction season and final project close out planned for end-2018.
Additional Construction Administration efforts over and beyond the original effort includes additional field visits,
construction meetings,processing of pay vouchers,daily communication and modification af construction
documents,The following assumptions are included:
~Average 14hrs/week beginning in the June 2018 thru October 2018;22 weeks.
Task A Subtotal -$50,000.00
In consideration for these services,the City agrees to adjust the Contract Schedule for services performed by the
Consultant under this Contract Amendment of the anginal project.

jn consideration for these services,the City agrees to adjust the compensation for services penormed by the Consultant.
These fees are based on Ihe standard hourly rates of the Consultant's personnel actually engaged in the pedormance of
the services,plus direct out-of-pocket costs for expenses incurred by personnel who are actually engaged in the work
and other direct costs.The total Hourly Not-to-Exceed fees for the professional engineering services as described in this
amendment are as follows;
II.Resident Consultant Services
Task A $50,000.00
THIS AMENDMENT is subject to all provisions of the original Agreement.
THIS AMENDMENT,together with the original Agreement represents the entire and integrated AGREEMENT
between the City and Consultant.
THIS AMENDMENT executed the day and year written above.
