APPROVING ENGINEERING SERVICES AMENDMENT NO.1 BETWEEN THE CITY OF
WAUKEE AND FOTH INFRASTRUCTURE AND ENVIRONMENT,LLC [ALICE'S ROAD
CORRIDOR PROJECT PHASE 5[
IN THENAME AND BY THEAUTHOEITYOF THE CITY OF IYAUKEE,IONA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,on February 21,2017,the Waukee City Council approved an Agreement for Professional
Consulting Services with Foth Infrastructure &Environment,LLC [Reconstruction Design Services,
SE Alice's Road from North of Olson Drive to North of Hickman Road (Phase 5)](Resolution ¹17-
112);AND,
WHEREAS,Foth Infrastructure &Environment,LLC,has submitted Amendment No.I to the
agreement for additional services associated with right-of-way acquisition,project coordination,design
services,and construction administration;AND,
WHEREAS,the City Attorney has reviewed the proposed amendment and finds it satisfactory.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Engineering Services Amendment No.I between the City of Waukee and Foth Infrastructure and
Environment,LLC [Alice's Road Corridor Improvements Phase 5],attached hereto as Exhibit A,is
hereby approved.
Passed by the City Council of the City of Waukee,Iowa,and approv e day of November,
2018.

the CITY OF WAUKEE,IOWA,hereinafter referred to as the "City",and FOTH INFRASTRUCTURE AND
ENVIRONMENT,LLC.,hereinaffer referred to as the "Consultant",for professional services in connection with the

I.Basic Services of the Consultant
TASK A —Additional Services for Hy-Vee Development Agreement
The Consultant completed the following additional service as part of the project.
Task A.1 Exhibit Pre aration
Exhibits for the project meetings consisted of aerial mosaics for the project with the major project features
indicated on the aerial photograph.Include coloring,lettering,and other techniques to dehneate the
proposed design concepts and right of-way needs,including typical sections of the roadway.The figure
indicated right-of-way needs,property lines,property ownership,access control lines,grading hmits,and
new project improvements.
Task A.2 Pro'ect Coordination with Ad'acent Landowner's En ineerin Consultant
The Consultant conducted additional meetings to address specific conflicts and concerns.Meetings
coordinated the proposed City project with proposed site improvements required to ensure future signal
performs at acceptable Level of Service.
Task A 3 Additional Plattin Services
Revised acquisition plate and legal descriptions for property to be acquired for the Project and perform land
corner and lot surveys as needed for the preparation of the acquisition plate and legal descriptions for each
parcel.Said plate and legal descriptions shall comply with requirements of the lowe Code and shall be
prepared by or under the direct supervision of a licensed land surveyor under the laws of the State of lowe.The
following numbers of additional plate were delivered.

TASK B —Additional Proposed Signal on Alice's Road at Hy-Vee's Main Entrance
The Consultant completed the following additional service as part of the project.
Task B.1 Additional Plattin Services
Revised acquisition plate and legal descriptions for properly to be acquired for the Project and perform land
corner and lot surveys as needed for the preparation of the acquisition plate and legal descriptions for each
parcel.Said plate and legal descriptions shall comply with requirements of the lowe Code and shall be
prepared by or under the direct supervision of a licensed land surveyor under the laws of the State of iowa.The
followrng numbers of additional plate were delivered.

Task B.2 Traffic Si nal Desi n
This task consists of the final design and drafting of the traffic signals at the main entrance to Hy-Vee off of
NE Alice's Road.Included in this task will be the signal layout,wiring diagrams,major equipment locations,
special provisions and other elements of the traffic signal installation,as necessary to accommodate the
intersection geometric design,as well as phasing and timing of traffic signals,and additional plan sheets to
incorporate the signal into the original Alice's Road Plan Set.
Task B.3 Traffic Si nal Construction Administration
Additional Construction Administration efforts over and beyond the original effort includes additional
field visits,construction meetings,processing of pay vouchers,daily communication and modification
of construction documents.It is assumed a total of 20 hours will be required

The Consultant completed the following additional service as part of the project.

The Consultant conducted additional meetings to address specific conflicts and concerns.Meetings
coordinated the proposed City project with proposed future site improvements to ensure future signal performs
at acceptable Level of Service.
Task C.3 Additional To o ra hic Surya
The Consultant performed the following additional topographic surveys to determine,the revised location of
the storm sewer outlet,the amount of additional earthwork needed and driveway tie in elevations.This
information was used to develop the existing ground DTM for the Project site.
Task C.4 Additional Plattin Services
Revised acquisition plate and legal descriptions for property to be acquired for the Project and perform land
corner and lot surveys as needed for the preparation of the acquisition plate and legal descriptions for each
parcel.Said plate and legal descriptions shall comply with requirements of the iowa Code and shall be
prepared by or under the direct supervision of a licensed land surveyor under the laws of the State of lowe.The

Task C 5 Additional Desi n Services
The Consultant redesigned the 48-Inch diameter storm sewer trunk line to outlet farlher east into the adjacent
property as well as designed a new driveway that aligns with Hy-Vee's full access and permanent signal.

TASK D —Additional Services for Continental 296 Fund LLC Development Agreement
The Consultant completed the following additional service as part of the project.

The Consultant redesigned Alice's Road to continue the west half of the full build 4-lane typical section from the
north property line of Hy-Vee to NE Horizon Drive.

The Consultant completed the following additional service as part of the project.

circulation.

Task G.6 Condemnation Services
This task included a formal project description and additional exhibits that were included in the Public Notice,as
well as attending the Condemnation Hearing to provide testimony on behalf of the City to the Compensation
Commission.

The Consultant designed an additional access driveway which relocates the existing BDL driveway to the
property line for better site circulation between BDL Properties and JRC Investments.This task also include a
formal plan revision to incorporate driveway relocation into the Alice's Road construction project.

Task I 3 Final Plans and S ecifications
The Consultant performed final design services in the preparation of design plans and specifications depicting
the proposed utihty relocation,and other features of the project.The final pfans will include but not be limited to
the following tasks:
Task I 3 1 Final Title Sheets A Sheets
This task consists of finalizing the title sheet.The title sheets will include the following.Index of
sheets,Legend,Location Map,and Project Number.
Task I 3 2 Final T ical Sections B Sheets
This task consists of final design and drafting of typical cross sections and standard details to be
utilized for the improvements
Task I 3 3 Final Quantities C Sheets
This task consists of the final bid items to be included in the Project,as well as final quantity
tabulations and the development of the general notes and estimate reference information.This item
also includes the final design and drafting of erosion control measures to be provided on the Project.
Task I 3 4 Final Joint Trench Desi n N Sheets
This task consists of final design of the joint trench layout and necessary details.This task will include
utility coordination to ensure adequate handhole spacing and connections to existing services.

This task consists of providing a Project Manual for the Project,including Notice of Public Hearing and
Notice to Bidders,Instruction to Bidders,Bid Forms,Bond Forms,Agreement Forms,General Conditions of
the Construction Contract,Supplementary General Conditions,and Detailed Construction Specifications.
Task I 5 Additional Pro'ect Biddin
The Consultant will coordinate and manage the letting process for the project.For estimating purposes,
~one 1 letting has been included as part of this task.The work tasks to be performed or coordinated by the
Consultant shall include the following:
Task I 5 1 —Printin of Plans and S ecifications
This task consists of printing and handling of the Plans and Specifications.For budget purposes it is
estimated that twenty (20)half-size (11"x17")plan sets and specifications will be duplicated and
assembled by the Consultant.This task also includes dissemination of the contract documents and
maintaining a plan holders list during the bidding phase.
Task 1.5.2 —Notice of Pro'ect
The Consultant shall prepare of the formal Notice of Public Hearing and formal Notice to Bidders.The
City shall handle publication of the Notice of Public Hearing and posting of Notice to Bidders.The
Consultant shall also prepare and disseminate a Notice of Project to the contractors concerning the
upcoming Project.
Task I 5 3 —Plan Clarification and Addenda
The Consultant shall be available to answer questions from contractors prior to the letting and shall
issue addenda as appropriate to interpret,clatify or expend the bidding documents.
Task I 5 4 —Lettin Bid Tabs and Award Recommendation
The Consultant shall be a representative present when the bids and proposals are opened,shall make
tabulations of bid for the Owner,shall advise the Owner on the responsiveness of the bidders and
assist the Owner in making the award of contract,including preparation of necessary contract
documents.

Task 1.6 Construction Administration
Additional Construction Administration efforts over and beyond the original effort includes additional field
visits,construction meetings,processing of pay vouchers,daily communication and modification of
construction documents.Average 6 hrs/week beginning in the April of 2018 thru June 2018

jn consideration for these services,the City agrees to adjust the compensation for services performed by the Consultant.
These fees are based on the standard hourly rates of the Consultant's personnel actually engagedin the performance of
the services,plus direct out-of-pocket costs for expenses incurred by personnel who are actually engaged in the work
and other direct costs.The total Hourly Not-to-Exceed fees for the professional engineering services as described in this
amendment are as follows:

THIS AMENDMENT is subject to all provisions of the original Agreemsnt.
THIS AMENDMENT,together with the original Agreement represents the entire and integrated AGREEMENT
between the City and Consultant.
