APPROVING TEMPORARY CONSTRUCTION EASEMENT (A)FOR THE WAUKEE
HIGH SCHOOL NO.2 PROJECT [PHILIP E.BRODERICK REVOCABLE TRUST
AND CHARLOTTE R.BRODERICK REVOCABLE TRUST]
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF 8'A UKEE,IO 8'A
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,it has been determined that temporary construction easements are necessary for the
purpose of construction of City infrastructure improvements adjacent to the Waukee High School
No.2 Project;AND,
WHEREAS,said easements shall be located on a portion of the property owned by Philip E.
Broderick Revocable Trust and Charlotte R.Broderick Revocable Trust,and legally described as
referenced in Exhibit A,Easement Area,of the Temporary Construction Easement,which is
attached hereto.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
15'"day of October,2018,that it hereby approves the Temporary Construction Easement (A)for
the Waukee High School No.2 Project [Philip E.Broderick Revocable Trust and Charlotte R.
Broderick Revocable Trust]in the amount of $L00.

The General Location ol the Project begins approximately 2,600 feet notsh ol'IJS I hvy 6
on N.10'"Street in the NW '/i of Section 28 of I'ownship 70N Range 26W in the City ol'
Waukce.
I'his temporary construction easement shall terminate and bc of no force and
elfect one (I)year after the date of Iinal completion and acceptance ol said completed
improvements by the City.
'I'hc Grantee tlgl'ees to restore the ldasement Area to a condition alter construction
substantially the same as prior to entry by the Grantcc,except for any i.*rading and above
gtound improvenients which shall remain in place as ptll't of the improvement.I'he
surt'ace of the I ascmcnt Area will be seeded or soddecl and/or lett in its natural state as
shown on the proposed plans for the project.

the easement herein granted.

in-interest,that said Grantor holds said real estate dcscribcd in this Easement Area by title
in fee simple:that Grantor has good and lawful authority to sell and convey the same;and
thai said Grantor covenants to &VARRAN'f'AND DEFEND the said premises against the
