RESOLUTION 13-169
APPROVING DEVELOPER'S AGREEMENT BETWEEN THE CITY OF WAUKEE;
WAUKEE COMMUNITY SCHOOL DISTRICT;AND DILIGENT BSP HOLDINGS,
LLC RELATED TO SE L.A.GRANT PARKWAY IMPROVEMENT PROJECT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Waukee C0l11111UlritySchool District has received approval to build Timberline
School to be located at 2605 SE LA Grant Parkway which will be open for the 2015-2016 school
year;AND
WHEREAS,traffic generated by the development of the school requires improvements to SE
LA Grant Parkway including the construction of a left tum lane,right turn lanes,curb and gutter
and associated utilities;AND,
WHEREAS,Diligent BSP Holdings,LLC owns property adjacent to the proposed Timberline
School which will also benefit from the improvements made to SE LA Grant Parkway;AND,
WHEREAS,the Waukee Community School District and Diligent BSP Holdings,LLC have
entered into an agreement with the City regarding the construction of the improvements to SE
LA Grant Parkway.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,Iowa
on this 1st day of July,2013 that the Developer's Agreement between the City of Waukee,
Waukee Community School District and Diligent BSP Holdings,LLC is hereby accepted and
approved by the City Council of the City of Waukee.~~.ze~
