HomeMy WebLinkAbout2013-08-19-Resolutions 13-222_Alice's Rd-105th St Interchange - IJR Supplemental Agr 3THE CITY OF WAUKEE,IOWA RESOLUTION 13-222 APPROVING SUPPLEMENTAL AGREEMENT NO.3 WITH KIRKHAM MICHAEL & ASSOCIATES,INC.,RELATED TO ENGINEERING SERVICES FOR THE ALICE'S ROAD INTERCHANGE IJR,ENVIRONMENTAL ANALYSIS AND FINAL DESIGN IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas County; AND, WHEREAS,the Cities of Waukee and West Des Moines are actively pursuing the construction of an interchange at the intersection of 1OSth Street!Alice's Road and Interstate 80 (1-80);AND, WHEREAS,the City of Waukee has previously entered into agreements for engineering services with Kirkham Michael &Associates,Inc.,related to the Alice's Road Interchange project (Resolutions #08-31,11-186,12-189 and 13-100);AND, WHEREAS,the agreement with Kirkham Michal must be amended to reflect additional work necessary to complete the project including geotechnical exploration and work associated with the removal of the rest areas; NOW THEREFORE BE IT RESOLVED by the Waukee City Council that the City of Waukee hereby approves Supplemental Agreement No.3 with Kirkham Michael &Associates, Inc.,related to engineering services for the Alice's Road Interchange IJR,Environmental Analysis and Final Design,attached hereto as Exhibit A. Passed by the City Council of the City of Waukee,Iowa,and approved the 19th day of August, 2013. Attest: Rebecca D.Schuett,City Clerk ROLL CALL VOTE Shane Blanchard Casey L.Harvey Shelly Hughes C.Isaiah McGee Mike Watts AYE X X X X X NAY ABSENT ABSTAIN EXHIBIT A Letter Agreement Supplement -Iowa M\\!?KIRKHAMl..N~MICHAEL Arizona +Iowa Keneas e Nebraska www.kirkham.com SUPPLEMENTAL AGREEMENT NO.3 This Supplemental Agreement made and entered into on this lq1l1 day of July 2013,by and between the City of Waukee,hereinafter referred to as the "Owner"and the firm of Kirkham,Michael &Associates,Iuc.,hereinafter referred to as the II Consultant.II PREAMBLE: The parties hereto entered into an agreement dated the 26 day of September,2011,and Supplemental Agreement No.1 dated the 27th day of August 2012,and Supplemental Agreement No.2 dated the 15th day of April,2013 for the Alice's Road Interchange lJR,Environmental Analysis and Final Design.Work is to be conducted in accordance with current Iowa Department of Transportation local system project administration requirements.Said contract shall hereinafter be referred to as the Base Agreement. The Owner desires to have the Consultant perform additional engineering assignments in conjunction with the preliminary planning,preliminary design,right of way design,final design,bidding assistance,construction administration,and site observation.The work to be performed is beyond the scope of the Base Agreement and Supplements I and 2,thereby constituting "extra work." The Consultant is willing to provide said services. AGREEMENT: The parties,in consideration of these mutual promises contained herein,agree to the following: 1.SCOPE OF SERVICES The additional work to be performed by the Consultant nnder this Supplemental Agreement No.3 shall encompass and include all detail work,services,materials,equipment,and supplies necessary to complete the following described work. 1.1 Provide additional gcotecnnical investigation to be conducted by Terracon under sub-contract to the Consultant in conformance with their proposal P08130236rev Idated May IS,2013 and revised June 12,2013 and allacbed hereto.Email authorization to perform this work was provided on June 13,2013 and Terracon was issued a notice to proceed by the Consultant on June 13,2013,Appl'Oximate fee:$93,600.00 1.2 Provide,if required,a regulated materials inspection and abatement design for the buildings located at the Dailas County Rest Areas.Work also includes point testing anei monitoring of the abatement during removal if required.Work is to be provided by Terracon under sub-contract to the Consultant in conformance with their proposal P08130448 dated July 22,2013 attached hereto.Approximate Fee:$27,995 10f3 11021 Aurora Avenue'Des Moines,]A 50322'(515)270-0848 •FAX (515)270-'1067 1.3 Provide,if required,testing of the Rest Area lagoon sludge to determine suitability for eitherlaud application or processing at the Des Moines Wastewater Treatment Plant and volume (for estimating purposes),Work is to be provided by Terracon under sub-contract to the Consultant in conformance with their proposal P08130448 dated July 22,2013 attached hereto.Approximate fee $13,550 1.4 Provide plans and specifications for demolition and removal of the Dallas County Rest Areas (buildings,paving,lagoons,utilities,and other features)adjacent to the project site.This work includes coordination with the Iowa DOT and the Iowa DNR.The plans will be incorporated into the plans for construction of the Interchange Project.Approximate Fee:$16,700 1.5 Prepare additional legal descriptions and plats required for the acquisition of right-of-way and easements for the project.This tasks increases the number plats from 6 as per supplement No 1 to 20 required by the current design.Approximate Fee:$28,000 1.6 Provide Project Management for the above listed tasks.Approximate Fee:$7,600 Total maximum amount for contract supplemeut:$187,445.00 2.TIME OF BEGINNING AND COMPLETION The Owner authorized work to begiu on Supplement 3 Task 1.1 in an email dated June 13,2013.Task 1.2 will require a separate authorization to proceed if the work is determined necessary.Authorization for all other Tasks shall be provided upon execution of this Supplemental Agreement. The contract ceiling amount is hereby increased by an amount of $187,445 from $986,640 to $1.174.085 which shall not be exceeded without written authorization from the Owner. Except as specifically amended by this Supplemental Agreement No,3,all the terms and conditions of the Base Agreement and Supplements No.1 and No.2,shall remain in full force and effect.
