RESOLUTION 13-240
TO FIX A DATE OF MEETING AT WHICH IT IS PROPOSED TO APPROVE AN
ORDINANCE ESTABLISHING THE ALICE'S ROAD CORRIDOR SEWER
CONNECTION FEE DISTRICT PURSUANT TO SECTION 384.38 OF THE CODE OF
IOWA
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Section 384.38 of the Code ofIowa authorizes cities to establish by
ordinance connection fee districts and corresponding schedules of fees in order to allocate the
cost of improvements necessary to extend sewer service to properties within such a district;and
WHEREAS,pursuant to Section 384.38,the City of Waukee (the "City")has proposed
to establish the Alice's Road Corridor Sewer Connection Fee District (the "District")with a
corresponding schedule of connection fees,has prepared an ordinance for such purpose and it is
now necessary to set a date for a hearing on such proposal and to make provision for the
publication of notice thereof;
NOW THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,
Iowa,on this 16th day of September,2013,as follows:
Section 1.This Council shall meet on the 7th of October,2013,at five thirty o'clock
(5:30)p.m.,at the Waukee City Hall,in the City,at which time and place a public hearing will
be held and the Council may take action to approve an ordinance establishing the Alice's Road
Corridor Sewer Connection Fee District,a copy of which has been placed on file in the office of
the City Clerk.
Section 2.The City Clerk is hereby directed to give notice of the proposed action,the
time when and place where said meeting will be held,by publication at least once not less than
twenty days before said meeting in a legal newspaper of general circulation in the City.Said
notice shall be in substantially the following form:
NOTICE OF PUBLIC HEARING CONCERNING THE PASSAGE OF AN ORDINANCE
ESTABLISHING THE ALICE'S ROAD CORRIDOR SEWER CONNECTION FEE
DISTRICT PURSUANT TO SECTION 384.38 OF THE CODE OF IOWA
The City Council of the City of Waukee,Iowa,will meet at the Waukee City Hall,on the
October 7,2013,at 5:30 o'clock p.m.,at which time and place a hearing will be held and
thereafter action may be taken to conceming an ordinance establishing the Alice's Road Corridor
Sewer Connection Fee District,as authorized by Section 384.38 of the Code ofIowa.A copy of
said proposed ordinance has been placed on file in the office of the City Clerk.
The Alice's Road Corridor Sewer Connection Fee District shall serve to equitably
distribute the costs associated with the Alice's Road Corridor Sewer extension so as to allow the
conveyance of sanitary sewer waste for treahnent from the benefited area constituting the
district.The extension was necessary to extend sanitary sewer to the property within the district.
The Alice's Road Corridor Sewer Connection Fee District shall include the property
described on Exhibit A.
The connection fee being considered will be in an amount equal to the maxirnum acre
area of contiguous property,or fraction thereof,within the connection fee district,under such
ownership which can be served through such proposed cormection,multiplied by the per acre
connection fee established in the Ordinance.Approval of a final plat or the issuance of building
permits and/or Mobile Home Permits shall not occur until such time as any and all fees have
been paid in full.
The improvements extending sewer capability to the property in the district consist of
Construction of the Alice's Road Corridor Sewer proj ect included approximately,11,117 linear
feet of 24-inch diameter gravity flow sanitary sewer,595 linear feet of 18-inch diameter gravity
flow sanitary sewer,708 linear feet of I5-inch to 8-inch diameter gravity flow sanitary sewer,
manholes,drop connections,clearing and grubbing,surface restoration,and miscellaneous
associated work.
The project began near an existing manhole located on the north side of Interstate 80
approximately 4,600 feet east of County Highway R-22 (also known as Ute Avenue).From the
manhole,a 24-inch diameter sewer was extended northeasterly to a point on the east side of
Alice's Road.The sewer was then extended north along the eastern right-of-way of Alice's Road
to the intersection of Alice's Road and the future Westown Parkway.
The project's construction costs total $2,787,067.21,excluding financing and other costs
incurred by the City to facilitate the project.The proposed fees are to be based upon the equitable
costs of extending sewer service to the properties in the district,which comprises approximately
660 developable acres.The fees may be amended or modified by action of the City Council as it
deems appropriate.Fees are being considered on a per acre basis in the amount of $4,000.00 per
acre.An automatic escalation may be considered and enacted with regard to the connection fee
being considered.If enacted,the connection fee would continue until adjusted or otherwise
amended through action of the City Council of the City of Waukee,Iowa
At the meeting,the Council will receive oral or written objections from ally resident or
property owner of the City.Thereafter,at the meeting or at an subsequent meeting,the Council
may:
I.Create the connection fee district as proposed and affirm the proposed connection fee.
2.Alter the proposed connection fee district or the proposed connection fee;or
3.Make any other provision relative to the proposed connection fee district or connection fee
which the council determines to be equitable in the premises.
This notice is given by order of the City Council of Waukee,Iowa,in accordance with
Section 384.38 of the Code ofIowa and applicable provisions of the Waukee Municipal Code.
