HomeMy WebLinkAbout2013-10-21-Resolutions 13-268_Little Walnut Creek Regional Lift Station Connect Fee District - Set PHTHE CITY OF WAUKEE,IOWA RESOLUTION 13-268 TO FIX A DATE OF MEETING AT WHICH IT IS PROPOSED TO APPROVE AN ORDINANCE ESTABLISHING THE LITTLE WALNUT CREEK REGIONAL LIFT STATION CONNECTION FEE DISTRICT PURSUANT TO SECTION 384.38 OF THE CODE OF IOWA IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA WHEREAS,Section 384.38 of the Code ofIowa authorizes cities to establish by ordinance connection fee districts and corresponding schedules of fees in order to allocate the cost of improvements necessary to extend sewer service to properties within such a district;and WHEREAS,pursuant to Section 384.38,the City of Waukee (the "City")has proposed to establish the Alice's Road Corridor Sewer Connection Fee District (the "District")with a corresponding schedule of connection fees,has prepared an ordinance for such purpose and it is now necessary to set a date for a hearing on such proposal and to make provision for the publication of notice thereof; NOW THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee, Iowa,on this 21 st day of October,2013,as follows: Section 1.TIns Council shall meet on the 4th of November,2013,at five thirty o'clock (5:30)p.m.,at the Waukee City Hall,in the City,at which time and place a public hearing will be held and the Council may take action to approve an ordinance establishing the Little Walnut Creek Regional Lift Station Connection Fee District,a copy of which has been placed on file in the office of the City Clerk. Section 2.The City Clerk is hereby directed to give notice of the proposed action,the time when and place where said meeting will be held,by publication at least once not less than twenty days before said meeting in a legal newspaper of general circulation in the City.Said notice shall be in substantially the following form: NOTICE OF PUBLIC HEARING CONCERNING THE PASSAGE OF AN ORDINANCE ESTABLISHING THE LITTLE WALNUT CREEK REGIONAL LIFT STATION CONNECTION FEE DISTRICT PURSUANT TO SECTION 384.38 OF THE CODE OF IOWA The City Council of the City of Waukee,Iowa,will meet at the Waukee City Hall,on the November 4,2013,at 5:30 o'clock p.m.,at which time and place a hearing will be held and thereafter action may be taken to concerning an ordinance establishing the Little Walnut Creek Regional Lift Station Connection Fee District,as authorized by Section 384.38 of the Code of Iowa.A copy of said proposed ordinance has been placed on file in the office of the City Clerk. The Little Walnut Creek Regional Lift Station Connection Fee District shall serve to equitably distribute the costs associated with the Little Walnut Creek Regional Lift Station extension so as to allow the conveyance of sanitary sewer waste for treatment from the benefited area constituting the district.The extension was necessary to extend sanitary sewer to the property within the district. The Little Walnut Creek Regional Lift Station Connection Fee District shall include the property described on Exhibit A. The connection fee being considered will be in an amount equal to the maximum acre area of contiguous property,or fraction thereof,within the connection fee district,under such ownership which can be served through such proposed connection,multiplied by the per acre connection fee established in the Ordinance.Approval of a final plat or the issuance of building permits and/or Mobile Home Permits shall not occur until such time as any and all fees have been pai d in full. The project begins at a point approximately 1,150 feet north of the intersection ofN Warrior Lane and NE Fox Run Trail.From that point an 18-inch diameter sewer was extends north along the west side ofN Warrior Lane approximately 1,000 linear feet to a lift station.From the lift station an 8-inch force main extends back south along the west side ofN Warrior Lane to an existing manhole at the intersection ofNE Gracewood Drive and N Warrior Lane for Phase I of the project.For Phase 2 a 16-inch force main will continue south along the west side ofN Warrior Lane to Hickman Road, west along the north side of Hickman Road and then south along 4th Street to an existing manhole at the intersection of 4th Street and Maple Street. Construction of Phase I ofthe Little Walnut Creek Regional Lift Station project included approximately,2,650 linear feet of 8-inch diameter force main,1,045 linear feet of 24-inch to 18- iuch diameter gravity flow sanitary sewer,manholes,clearing and grubbing,surface restoration,0.6 mgd capacity lift station and miscellaneous associated work. Phase 2 of the Little Walnut Creek Regional Lift Station will include replacing the pumps and generator to increase the capacity of the lift station to 2.0 mgd and extending the force main from the intersection ofNE Gracewood Drive and N Warrior Lane to the intersection of 4th Street and Maple Street. The project's construction costs total $2,802,706.80,excluding financing and other costs incurred by the City to facilitate the project.The proposed fees are to be based upon the equitable costs of extending sewer service to the properties in the district,which comprises approximately 585 developable acres.The fees maybe amended or modified by action of the City Council,as it deems appropriate.Fees are being considered on a per acre basis in the amount of $4,700.00 per acre.An automatic escalation may be considered and enacted with regard to the connection fee being considered.If enacted,the connection fee would continue until adjusted or otherwise amended through action of the City Council of the City of Waukee,Iowa At the meeting,the Council will receive oral or written objections from any resident or property owner of the City.Thereafter,at the meeting or at an subsequent meeting,the Council may: 1.Create the connection fee district as proposed and affirm the proposed connection fee. 2.Alter the proposed connection fee district or the proposed connection fee;or 3.Make any other provision relative to the proposed connection fee district or connection fee which the council determines to be equitable in the premises.
