HomeMy WebLinkAbout2013-11-04-Resolutions 13-294_Alice's Rd-105th St Interchange - IJR Supplemental Agr 4THE CITY OF WAUKEE,IOWA RESOLUTION 13-294 APPROVING SUPPLEMENTAL AGREEMENT NO.4 WITH KIRKHAM MlCHAEL & ASSOCIATES,INC.,RELATED TO ENGINEERING SERVICES FOR THE ALICE'S ROAD INTERCHANGE IJR,ENVIRONMENTAL ANALYSIS AND FINAL DESIGN IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas County; AND, WHEREAS,the Cities of Waukee and West Des Moines are actively pursuing the construction of an interchange at the intersection of 105[!lStreet/Alice's Road and Interstate 80 (1-80);AND, WHEREAS,the City of Waukee has previously entered into agreements for engineering services with Kirkham Michael &Associates,Inc.,related to the Alice's Road Interchange project (Resolutions #08-31,11-186,12-189,13-100 and 13-222);AND, WHEREAS,the agreement with Kirkham Michael must be amended to reflect additional work necessary to complete the proj ect including design for a pedestrian underpass; NOW THEREFORE BE IT RESOLVED by the Waukee City Council that the City of Waukee hereby approves Supplemental Agreement No.4 with Kirkham Michael &Associates, Inc.,related to engineering services for the Alice's Road Interchange DR,Environmental Analysis and Final Design,attached hereto as Exhibit A. 1>(11'\,aJOIll V'lW Passed by the City Council of the City of Waukee,Iowa,and approved the W day of/mgllsl, 2013. PREAMBLE: The parties hereto entered into an agreement dated the 26 day of September,2011,and Supplemental Agreement No.I dated the 27th day of Augost 2012,and Supplemental Agreement No.2 dated the IStl'day of April,2013, and Supplemental Agreement No.3 dated the 19'h day of JUly,2013 for the Alice's Road Interchange DR, Environmental Analysis and Final Design.Work is to be conducted in accordance with current Iowa Department of Transportation local system project administration requirements.Said contract shall hereinafter be referred to as the 13 ase Agreement. The Owner desires to have the Consultant perform additional engineering assignments in conjunction with the preliminary planning,preliminary design,right of way design,final design,bidding assistance,construction administration,and site observation.Tbe work to be performed is beyond the scope of the Base Agreement and Supplements 1,2 and 3,thereby constituting "extra work." The Consultant is willing to provide said services. AGREEMENT: The parties,in consideration of these mutual promises contained herein,agree to the following: 1.SCOPE OF SERVICES The additional work to be performed by the Consultant under this Supplemental Agreement No.4 shall encompass and include all detail work,services,materials,equipment,and supplies necessary to complete design revisions associated with the addition of a pedestrian underpass of Alices Road approximately 900 feet south of Ashworth Road at Station 21105+25.Design for the pedestrian underpass includes tbe following tasks 1.1 Revisions to the previously approved center line profile grade including modeling,cross-sections, grading limits and other details impacted by the profile grade revision. 1.2 Revisions to the previously approved storm drainage plan and layout impacted by the pedestrian underpass. 1.3 Revisions to and addition of permanent easement description and parcel maps required for the pedestrian underpass. lof2 11021 Aurora Avenue'Des Moines,JA 50322 •(515)270-0848 •FAX (515)270-1067 ].4 Revisions to the previously approved grading scheme to provide trail access from the trails along the roadway to the pedestrian underpass. 1.5 Design of a ]6 foot wide by an approximate]2 foot tall pedestrian underpass including wing walls,footings,aesthetic features,and infrastructure for lighting,The underpass is approximately 220 feet in length.It is assumed that the design will utilize a Con/Span B-Series Bridge System or similar product that will be placed on cast-in-place concrete walls with footings. 1.6 Coordinate with the City's architect,Confluence,for design of aesthetic features and infrastructure for lighting. ].7 Provide Project Management for the above listed tasks. The total maximum fee for the above described tasks and Supplement Number 4 is $82,000.00 2.TIME OF BEGINNING AND COMPLETION The Owner authorized work to begin on Supplement 4 in an email dated _ Design work is anticipated to continue through June 2014. 3.FEES AND PAYMENTS The engineer shall be paid on an hourly basis for direct time worked on the project at rates determined by raw labor times a net multiplier of 3.199 to cover salary,additives,overhead and profit.The engineer will be reimbursed for direct project expenses such as sub-consultants,mileage,and miscellaneous expenses as estimated above. The contract ceiling amount is hereby increased by an amount of $82,000 from $1,174,085 to $1,256.085 which shall not be exceeded without written authorization from the Owner. Except as specifically amended by this Supplemental Agreement No.4,all the terms and conditions of the Base Agreement and Supplements No.1,No.2,and No.3,shall remain in full force and effect.
