HomeMy WebLinkAbout2014-04-21-Resolutions 14-101_Alice's Rd-105th St Interchange - IJR Supplemental Agr 5THE CITY OF WAUKEE,IOWA RESOLUTION 14-101 APPROVING SUPPLEMENTAL AGREEMENT NO.5 WITH KIRKHAM MICHAEL & ASSOCIATES,INC.,RELATED TO ENGINEERING SERVICES FOR THE ALICE'S ROAD CORRIDOR/I-SO INTERCHANGE IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas County; AND, WHEREAS,the Cities of Waukee and West Des Moines are actively pursuing the construction of an interchange at the intersection of 10S'h Street/road within the Alice's Road Corridor and Interstate 80 (I-80);AND, WHEREAS,the City of Waukee has previously entered into agreements for engineering services with Kirkham Michael &Associates,Inc.,related to the interchange project (Resolutions #08-31,11-186,12-189,13-100,13-222 and 13-294);AND, WHEREAS,the agreement with Kirkham Michael must be amended to reflect additional work to expand the scope of construction consultation work for the Interchange and Local Project; NOW THEREFORE BE IT RESOL YED by the Waukee City Council that the City of Waukee hereby approves Supplemental Agreement No.S with Kirkham Michael &Associates, Inc.,related to engineering services for the Alice's Road Corridor/I-80 interchange,attached hereto as Exhibit A. PREAMBLE: The parties hereto entered into an agreement dated the 26 day of September,2011,and Supplemental Agreement No.1 dated the 27th day of August 2012,and Supplemental Agreement No.2 dated the 1Sth day of April,2013,Supplemental Agreement No.3 dated the 19th day of July 2013,and Supplement NO.4 dated the 4th day of November,2013 for the Alice's Road Interchange IJR,Environmental Analysis and Final Design.Work is to be conducted in accordance with current Iowa Department of Transportation local system project administration requirements.Said contract shall hereinafter be referred to as the Base Agreement. The Owner desires to have the Consultant perform additional engineering assignments in conjunction with the preliminary planning,preliminary design,right of way design,final design,bidding assistance,construction administration,and site observation.The work to be performed is beyond the scope of the Base Agreement and Supplements 1,through 4,thereby constituting "extra work." The Consultant is willing to provide said services. AGREEMENT: The parties,in consideration of these mutual promises contained herein,agree to the following: 1.SCOPE OF SERVICES The additional work performed by the Consultant under this Supplemental Agreement No.5 shall encompass and include all detail work,services,materials,equipment,and supplies necessary to complete the work described in the Scope of Services,Exhibit A and Fee Estimates,Exhibit B to this agreement.The work in general includes the following tasks: Task 1:Provide additional Meetings,Coordination and Project Management activities including meeting agendas and attendance at meetings and conference calls,preparation of meeting notes, coordination with various entities within the Iowa DOT and Federal Highway Administration. Task 2:Additional work to complete the Interchange Justification Report (IJR) Task 3:Additional work to complete the Environmental Assessment (EA)and to amend the EA through technical memos. Task 4:Additional geotechnical work and environmental permitting work. lof4 11021 Aurora Avenue +Des Moines,fA 50322 +(515)270-0848 +FAX (515)270-1067 Task 5:Additional work associated with final Interchange signing design Task 6:Additional work to revise the signing design due to potential street name change Task 7:Construction Consultation for the Interchange Project Task 8:Construction Consultation for the "local"Waukee Project (Interchange to Ashworth) Task 9:Efficiencies in completing Preliminary Design 2.TIME OF BEGINNINGAND COMPLETION Design work will be completed by October 1,2014.Construction associated work is anticipated to extend to July 1,2016. 3.FEESAND PAYMENTS The engineer shall be paid on an hourly basis for direct time worked on the project at rates determined by raw labor times a net multiplier of 3.199 to cover salary,additives,overhead and profit.The engineer will be reimbursed for direct project expenses such as sub-consultants,mileage,and miscellaneous expenses as estimated above. The contract ceiling amount is hereby increased by an amount of $537,700 from $1,256,085 to $1,793,785 which shall not be exceeded without written authorization from the Owner, Except as specifically amended by this Supplemental Agreement No.5,all the terms and conditions of the Base Agreement and Supplements No.1 through 4 shall remain in full force and effect. Date:~Lf-/--,,-,'}O=Iy--'--__ Ri ard;;;L"Her ick,P,E.,Sr.Vice Prdident Date:~~,-tt!J/4-7 20f4 C;\Usera\lIu:rrick.\Dcsklop\Aliees Supplement 5\130402 Alices SUPP[l:1IlCIlL5 Scope .doc EXHIBIT A:SCOPE OF SERVICES Task 1:Provide additional Meetings,Coordination,and Project Management effort at the request of the Cities to facilitate keeping the IJRand Environmental Assessment moving forward in an efficient manner.This additional effort was warranted due the overall complexity of the project,the number of stakeholders Involved with the project,and the new innovative interchange type (Diverging Diamond Interchange)being designed.For nearly a year weekly coordination meetings or conference calls were required including meeting agendas and formal meeting notes,Other special meetings with reviewers of the plans and the IJRat DOT headquarters and at the District 1 and District 4 offices were required along with additional meetings with the la DOT Office of Location and Environment [OLE)for NEPA coordination.Additional coordinatlon with various departments and staff at the Iowa DOT and with the Federal Highway Administration (FHWA)as well as with both Cities was necessary during preliminary and final design.It is estimated that this increased level of coordination shortened the project time line by one year.The additional effort expended for meetings,coordinatlon,and overall project management totals $68,000. Task 2:Additional work to complete the Interchange Justification Report due to the number of reviews and coordlnatlon efforts required with the Iowa DOT and FHWA including research,review and comments on the innovative Directional Diamond Interchange.The additional effort expended on the IJRtotals $47,000. Task 3:Additional work to complete the Environmental Assessment due to the expansion of the EAlimits south from Wendover Road to Mills Civic Parkway,the work required to address issues associated with the removal of the Rest Areas,the number of repeated reviews and additional ccordlnatlon required with the OLEand others, and work subsequent to the EAapproval to address changes made during final design,including two Technical Memorandums.The additional effort expended on the EAtotals $91,000. Task 4:Additional geotechnical and environmental permitting services based on the final design was required by Terracon including meetings,stream mitigation plan,additional settlement and global stability analysis, remedial design,and revisions to S3 plans requested by the Iowa DOTtotaling $21,000. Task 5:Additional work associated with signing design and coordination including design modifications requested by the Iowa DOT,re-design of overhead sign structures,and relocation of existing signing revisions has been performed by Benesch totaling $21,300. Task 6:Future revlslons to the Interchange Signing as a result of a potential street name change impacting both post mounted and overhead signage,lettering dimensions,post spacing and quantities on the Interstate and on Alices Road.This effort is estimated at $17,500. 30f4 C:\Usersuhemc"k.\Des"klop\Alk:e:s Supplemc:nI5U30402 Aliees Supplement S Scope .dcc Task 7:Construction Consultation for the Interchange Project is estimated at 96 weeks from approximately September 1,2014 to approximately July 1,2016 and includes attendance at the pre-construction meeting, general consultation and responding to contractor questions,attendance at weekly contractor coordination meetings,reviewing contractor submitted shop drawings,providing minor plan revisions as may be necessary for change orders,providing as-constructed survey of drainage pipes and culverts,preparing as-constructed drawings based on the survey and markups provided by the contractor or Iowa DOT.This effort totals $195,900. Task 8:Construction Consultation for the City of Waukee Project (Interchange to Ashworth Road)Interchange Project is estimated at 66 weeks from approximately October 1,2014 to Approximately December 1,2015 and includes attendance at the pre-construction meeting,general consultation and responding to contractor questions,attendance at weekly contractor coordination meetings,reviewing contractor submitted shop drawings,providing minor plan revisions as may be necessary for change orders,processing monthly pay estimates based on information provided by the City of Waukee,providing as-constructed survey of drainage pipes and culverts,preparing as-constructed drawings based on the survey and markups provided by the contractor or the City.This effort is totals $127,000. Task 9:Efficiencies in completing Preliminary Design allowed Kirkham Michael to complete the preliminary design below budget resulting in a reduction ofJee by $51,000. The total value of Supplement No.5 is $537,700.
