RESOLUTION 14-115
APPROVING SECOND AMENDED AND RESTATED AGREEMENT WITH THE DES
MOINES METROPOLITAN WASTE WATER RECLAMATION AUTHORITY
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,Iowa is a duly organized municipal corporation
within the State ofIowa;AND
WHEREAS,the Des Moines Metropolitan Waster Water Reclamation Authority ("WRA")was
originally created by virtue of agreement dated February 19,1979,which was subsequently
amended July 1,2004,after which the Cities of Cumming,Polk City and Waukee joined as
parties to WRA;AND
WHEREAS,the member entities of the WRA consider it desirable to amend and restate the
original agreement through a Second Amended and Restated Agreement which has been
approved by the WRA Board,and is being circulated for approval by the various member
entities/communities;AND
WHEREAS,the City Administrators of Cumming,Polk City and Waukee have evaluated the
Second Amended and Restated Agreement and believe it is equitable for the Cities of Polk City
and Waukee to contribute to the City of Cumming $15,000 and $45,000,respectively,to
implement the Second Amended and Restated Agreement due to revisions in each respective
Cities'payment schedule as provided in the Second Amended and Restated Agreement,provided
the Second Amended and Restated Agreement is approved as required under existing agreements
and the City of Cumming approves the same;AND
WHEREAS,the City of Waukee and Polk City will benefit financially over the long term
relative to its payment obligation should the Second Amended and Restated Agreement be
approved;AND
WHEREAS,the City Council of the City of Waukee hereby determine that it is in the best
interest of the City to approve the Second Amended and Restated Agreement and the
arrangements set forth herein.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Second Amended and Restated Agreement should be and same is hereby approved subject to the
approval by and its becoming effective,after consideration of all member entities.
BE IT FURTHER RESOLVED,that upon the Second Amended and Restated Agreement
being approved,and becoming effective,and the City of Polk City agreeing to pay to the City of
Cumming $15,000,and the City of Cumming approving the Second Amended and Restated
Agreement,the City of Waukee shall pay the City of Cumming $45,000.
