RESOLUTION 14-131
APPROVING DEVELOPER'S AGREEMENT BETWEEN THE CITY OF WAUKEE;
WAUKEE COMMUNITY SCHOOL DISTRICT;AND PERFECT ACRES LLC
RELATED TO NE DOUGLAS PARKWAY IMPROVEMENT PROJECT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Waukee Community School District has requested approval to construct an
elementary school to be located at the intersection ofNE Douglas Parkway and NE Dartmoor
Drive which is scheduled to be opened in the fall of2016;AND
WHEREAS,as a part of the development of the new school,the construction ofNE Douglas
Parkway adjacent to the school is required including the construction of two through lanes,a
center grassed median,left tum lanes,curb and gutter and associated utilities;AND,
WHEREAS,Perfect Acres LLC owns property adjacent to the proposed NE Douglas Parkway
Improvements;AND,
WHEREAS,the Waukee Community School District will be making additional improvements
which would have otherwise been obligations of the City of Waukee or Perfect Acres LLC
related to NE Douglas Parkway;AND,
WHEREAS,the City of Waukee and Perfect Acres LLC have entered into an agreement with
the Waukee School District regarding the individual responsibility of the improvements being
made to NE Douglas Parkway.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,Iowa
on this 19th day of May,2014 that the Developer's Agreement between the City of Waukee,
Waukee Community School District and Perfect Acres LLC is hereby acce ted and approved by
the City Council of the City of Waukee.
