Lyon moved to approve the resolution; seconded by Council Member Sinclair. City Attorney Brick
briefly reviewed the history of negotiations with the property owners, noting that a condemnation
hearing was currently scheduled for February 21. He then reviewed the proposed agreements
with the property owners and the current property tenants. Council Member Bergman voiced her
concern with the City acting as a landlord for the property and also asked why the City would take
all instead of part of the property; Mr. Brick explained why a partial taking was not economically
feasible, adding that the City would not be paying any more for the property than was budgeted.
Development Services Director Deets noted that the school district would pay for a portion of the
purchase costs, as well. Mr. Brick then briefly reviewed state law related to tenant relocation.
Council Member Lyon and Mayor Clarke spoke in favor of the agreements. Council Member
Bergman suggested consideration of a policy to help avoid similar future issues; Mayor Clarke
noted that she had requested at an earlier meeting that there be better due diligence in the future
related to properties adjacent to roadway improvement projects. Mr. Brick gave a brief overview
