RESOLUTION 14-180
APPROVING 28E AGREKMKNT BETWEEN THK CITY OF WEST DES MOINES,
IOWA,AND THK CITY OF WAUKEE,IOWA,CONCERNING THK EXTENSION OF
TRUNK SEWERS FOR ACCESS TO THK DES MOINES METROPOLITAN
WASTEWATER RECLAMATION AUTHORITY SEWER SYSTEM
IN THE NAME AND BY THE A UTHOMTY OF THE CITY OF 8A UEEE,
IONIA
WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS,the Cities of Waukee and West Des Moines each maintains sewer infrastructure
owned and operated by each City which conveys wastewater generated in each City to the
Wastewater Reclamation Authority (hereafter referred to as "WRA")for treatment;AND,
WHEREAS,the Cities respective boundaries and physical geography make it desirable for one
City to occasionally obtain capacity in a sewer trunk line located within the other City's
boundaries in order to jointly convey sanitary sewer waste to the WRA for treatment and in order
to achieve maximum efficiency related to the conveyance of said sanitary sewer waste;AND,
WHEREAS,it is mutually desired to enter into an Agreement pursuant to Code of Iowa Chapter
28E for the purpose of establishing the rights and obligations of each City related to the
facilitation of the efficient and economical development of sewer facilities to allow the non-
duplicative conveyance of sanitary sewer waste to the WRA.
NOW THEREFORE BK IT RESOLVED by the Waukee City Council that the City of
Waukee hereby approves the 28E Agreement between the City of West Des Moines,Iowa,and
the City of Waukee,Iowa,concerning the extension of trunk sewers for access to the Des Moines
Metropolitan Wastewater Reclamation Authority Sewer System.
Passed by the City Council of the City of Waukee,Iowa,and approved th 7'"day of July,2014.
