HomeMy WebLinkAbout2014-08-04-Resolutions 14-209_Alice's Rd Corridor - Ashworth to University - Engineer Agr Amendment 4THE CITY OF WAUKEE,IOWA RESOLUTION 14-209 APPROVING ENGINEERING SERVICES AMENDMENT NO.4 BY AND BETWEEN FOTH INFRASTRUCTURE AND ENVIRONMENT,LLC,AND THK CITY OF WAUKEK RELATED TO THK ALICE'S ROAD/KKTTLKSTONE CORRIDOR PROJECT IN THE NAME AND BY THE AUTHORITY OF THE CITY OF 8'A USE,IOWA WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal Organization;AND, WHEREAS,the City of Waukee has previously entered into an Agreement for Engineering Services with Foth Infrastructure and Environment,LLC for services related to the Alice's Road Corridor, Ashworth Road to University Avenue Project (Resolution ¹08-201),as well as Engineering Services Amendment No.2 (Resolution ¹11-221)and Amendment No.3 (Resolution ¹13-040);AND, WHEREAS,in light of changes in the magnitude,complexity and number of projects,Foth Infrastructure and Environment,LLC,has provided Amendment No.4 to include additional services associated with resident review/engineering and final review/close-out,platting and right-of-way assistance,development of access management policy,and Centennial Park stream mitigation AND, WHEREAS,the engineering services agreement has been reviewed and approved by the Waukee City Attorney. NOW THEREFORE BK IT RESOLVED by the City Council of the City of Waukee that the Engineering Services Amendment No.4 related to the Alice's Road/Kettlestone Corridor Project, attached hereto as Exhibit A,is hereby approved. THIS AMENDMENT,made and entered into this ~L~&day of August,2014 by and between,the CITYical/I OF WAUKEE,IOWA,hereinafter referred to as the "City",and FOTH INFRASTRUCTURE AND ENVIRONMENT,LLC., hereinafterreferredtoasthe "Engineer",forprofessionalservicesinconnectionwiththeconce tualdevelo ment tra ic revlewanda al sis relimina surya andma in relimina desi n final lansands ecifications forthe ro osed construction of Alices Road from Ashworth Road to ust south of Universit Avenue hereby amends the original Agreement dated August 18,2008 as follows: The City and Engineer agree to amend the original Agreement to include additional services associated with: Resident Review/Engineering and Final Review/Close-out o Phase 1 —Alices Road —Ashworth Road to University Avenue o Phase 2 —Alices Road and University Avenue intersection o Phase 3-Alices Road and UniversityAvenue Signalization and Trail o Development of Access Management Policy Platting and Right-of-Way Assistance TASK A —Resident Review/Engineering and Final Review/Close Out: The original Agreement assumed one construction project estimated to be 4hrs /week of effort during the 2010 construction season.The magnitude,complexity and number of projects changed based on original assumptions in 2008.Currently three (3)projects are being constructed that will require construction Administragon Services during the 2013,2014 and 2015 construction seasons and final project close out in early 2016. Phase 1 —Alices Road —Ashworth Road to University Avenue (RISE Funding) Phase 2 —Alices Road and University Avenue Intersection (RISE Funding) e Phase 3-Alices Road and University Avenue Signalization and Trail (Federal Funding) Additional Construction Administration efforts over and beyond the original effort includes additional preconstruction meetings,review of construction shop drawings,field visits,construction meetings,processing of pay vouchers and Iowa DOT reimbursements for the RISE Project and Federal Funds,daily communication and rnoditication of construction documents .The following assumptions are included; ~Phase 1 -Average 16hrs/week beginning in the Fall of 2013 thru Fall 201 5 Phase 2 —Average 4hrs/week beginning in the Spdng 2014 thru the Spding 2015. Phase 3 —Average 4hrs/week beginning in the Spring of 2013 thru the Spring 2015 Note -'hours were reduced during winter shut down.Additional hours included to provide recorded drawings for each project. The increase in breakdown included in the following: Phase 1 -$160,970.00 ~Phase 2 —$46,400.00 Phase 3 —$42,100.00 Task A Subtotal -$249,470.00 Page 1 Foth infrastructure and Environment,LLC Project Number 08W061.00 Alices Road Ashworth Road to University Avenue Waukee,Iowa TASK 8 -Platting and Right-ofi Wa Negotiations: Additional right-of-way was required for the Gilcrest Jewett and Williams Point Plat 9 Parcels for the University Avenue and Alices Road Intersection Project.The following tasks are included: Task B.1 Pre are Ac uisition Plats —Gilcrest Jewett Williams Point Plat 9 and Giles Prepare acquisition plats and legal descriptions for property to be acquired for the regional storm water facility and additional plate and easements for the roadway improvements.Perform land corner and lot surveys as needed for the preparation of the acquisition plats and legal descriptions for each parcel.Said plats and legal descriptions shall comply with requirements of the lowe Code and shall be prepared by or under the direct supervision of a licensed land surveyor under the laws of the State of Iowa.The original and revised number of assumed plats are listed for estimating purposes: Permanent Right-of-Way Temporary Construction Easement Permanent Easement (Drainage/PUE) No. 5 2 0 Task B.2Pre areA r isals The Engineer shall coordinate and obtain the services from an independent fee appraiser for the purpose of preparing a value finding appraisal that determines the fair market value of the land and improvements to be acquired for the project,unless in the appraiser's professional opinion a "before and after"type of appraisal is required that addresses the severance damage to the remainder.The appraisals shall be completed using lowe DOT forms or formats.acceptable to the Iowa DOT and meet their standards.It is estimated that two appraisals will be required for Gilcrest Jewett and Williams Point Plat. 2 parcels @ $2,950.00/ea $5,900.00 Task B.3 Ne ot'ation Assistance The Engineer shall meet with the Property Owners and assist the City in answering technical questions as it relates to the proposed improvements and impacts to the respective properties.The Engineer shall review City prepared right-of-way agreements for accuracy and make recommendation as it relates to the technical aspects of the project Task B.4 Monumentation of Ac uisitions Plate This task consists of monumentation of the permanent acquisition acquired as part of this project which will be performed upon completion of construction of the proposed improvements,The monumentation shall comply with requirements of the lowe Code and shall be performed by or under the direct supervision of a duly licensed land surveyor under the laws of the State of lowe. This task does not include monumentation of any existing right-of-way pins that are disturbed during construction activities. Task B Subtotal -$19,990.00 Page 2 Foth Infrastructure and Environment,LLC Project Number 08W061.00 Aiices Road Ashworth Road to University Avenue Waukee,iowa TASK C —Access Management Guideline: The Engineer shall create an access management guideline for the City to use to determine the proper access spacing as development is initiated along the corridor.Guideline shall be based on SUDAS access spacing requirements and other Federal Highway Administration and Transportation Research Board and reference material.Guideline will utilize conceptual layout created by Confluence and identify major signalized intersections and future right-in and right-out (RIRO)locations. Task C Subtotal -$7,660.00 TASK D —Centennial Park Stream Mitigation —Topographic Survey (2,100 LF): The Engineer with conduct field surveys to obtain the topographic data,ground elevations,and cross sections required for the development of the channel mitigation and to supplement the existing mapping available from the City.This task also consists of incorporating the topographic features,profiles,and cross sections into the base mapping for the project Task D Subtotal -$8,850.00 In consideration for these services,the City agrees to adjust the Contract Schedule for services performed by the Engineer under this Contract Amendment of the origina!project. I.Construction Administration October 2013 to January 2016 In consideration for these services,the City agrees to adjust the compensation for services performed by the Engineer. These fees are based on the standard hourly rates.of the Engineer's personnel actually engaged in the performance of the services,plus direct out-of-pocket costs for expenses incurred by personnel who are actually engaged in the work and other direct costs.The additional total Hourly Not-to-Exceed fees for the professional engineering services as described.in this amendment are as follows: I.Basic Services of the Engineer Task A Task B Task C Task D Total $249,470.00 $19,990.00$7,650.00 8 850.00 $285,960.00 THIS AMENDMENT is subject to all provisions of the original Agreement.
