RESOLUTION 14-217
APPROVING MEMORANDUM OF UNDERSTANDING REGARDING SHARED USK OF
OUTDOOR WARNING SIREN LOCATED NEAR 50 LITTLE WALNUT CREEK DRIVE,
W'AUKKK,IOWA,BY AND BETWEEN THK CITIES OF CLIVE AND WAUKKK
IN THE NAME AND BY THE A UTHOMTY OF THE CITY OF WAUL',IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,in order to provide outdoor warning siren coverage within their designated geographical
boundaries,the Cities of Waukee and Clive propose a Memorandum of Understanding,attached hereto
as Exhibit A;AND,
WHEREAS,the Memorandum of Understanding addresses shared operation and costs associated with
an outdoor warning siren located near 50 Little Walnut Creek Drive within the city limits of Waukee;
AND,
WHEREAS,the Waukee City Attorney has reviewed the Memorandum and finds it satisfactory.
NOW THEREFORE BK IT RESOLVED by the City of Waukee City Council in session this 18"
day of August,2014,that it hereby approves Memorandum of Understanding Regarding Shared Use of
Outdoor Warning Siren Located Near 50 Little Walnut Creek Drive,Waukee,Iowa,by and between
the Cities of Clive and Waukee.

WEMIORANDUM OF UNDERSTANDING
REGARDING SHARED USE OF OUTDOOR WARNING SIREN LOCATED NEAR
50 WALNUT CREEK DRIVE,WAUKEE,IOWA
This Agreement made this ~9 day of 8R (f54,2014,by and between the City of Clive and the
City of Waukee.
WHEREAS,the undersigned entities desire to provide outdoor warning siren coverage within their
designated geographical boundaries;and
WHEREAS,the City of Waukee owns and maintains an outdoor warning siren near 50 Walnut Creek
Drive,Waukee,Iowa that provides overlapping coverage into portions of the City of Clive;and
WHEREAS,the City of Clive desires to share in ongoing costs of this existing outdoor warning siren;and
WHEREAS,the parties hereto desire to effect the purpose of this Memorandum of understanding
pursuant to shared use of an outdoor warning siren located near 50 Walnut Creek Drive,Waukee,Iowa.
NOW,THEREFORE,BE IT AGREED AS FQLLOWS:
1.The City of Waukee and the City of Clive desire to share in the operation and costs associated
with this outdoor warning siren.
2.The City of Waukee owns and operates this outdoor warning siren.
3.Routine activation and testing of this outdoor warning siren will be conducted using the policies
and procedures established by the City of Waukee.Copies of the policies and procedures
(including any future modifications)will be provided to the City of Clive.
4.Upon special circumstances,this outdoor warning siren may be activated for specific Clive needs.
5.The City of Clive will pay the City of Waukee 1/3 of the expenses related to upgrades for this
outdoor warning siren.The Cllve portion for planned upgrades during 2014 will be paid by the
City of Clive in July of 2015.
6.The City of Clive will pay the City of Waukee 1/3 of the expenses incurred related to ongoing
utility expenses,maintenance,and future upgrades for this outdoor warning siren.
Any party hereto may withdraw from this Memorandum of Understanding upon not less than thirty (30)
days adv e written notice by one party to the other party hereto,on or after August 1,2015.After such
withdra al,th withdraw'y shall have no further obligation or responsibly under this Memorandum
