RESOLUTION 14-229
APPROVING THK PARTIAL RELEASE OF DEVELOPMENT AGRKKMKNT FOX
CREEK ESTATES PLAT 4
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF SAUK',IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Fox Creek Estates,L.L.C.,an Iowa limited liability company,as "Property
Owner",and the City of Waukee,Iowa ("City"),entered into that ceitain Planned Development
Agreement dated May 31,2007,and filed June 20,2007,in Book 2007 at Page 9249 in the
records of the Dallas County Recorder ("Planned Development Agreement")AND,
WHEREAS,Perfect Acres,L.L.C.,an Iowa limited liability company ("Perfect Acres"),is a
successor Property Owner under the Agreement;AND,
WHEREAS,such Planned Development Agreement is not,and was never,intended to cover the
property and no obligations arise under said Agreement with respect to the property legally
described as:
All Lots within Fox Creek Estates Plat 4,an Official Plat in Waukee,Dallas County,Iowa,
NOW,THEREFORE BK IT RESOLVED,the City does hereby acknowledge that Perfect
Acres has satisfied its obligations pursuant to the Agreement in relation to the Property and the
Property is hereby released from the obligations and provisions of the reement on this 2"day
of September,2014.
