RESOLUTION 14-301
APPROVING DEVELOPMENT AGREEMENT WITH IOWA PROPERTY PARTNERS
LLC [3277 UTK AVENUE]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Iowa Property Partners,LLC (the "Owner")is the owner of property located at
3277 Ute Avenue which is currently being utilized as an auto auction;AND
WHEREAS,Owner has submitted a modified site plan for consideration by the City Council for
a paving addition but has indicated that they are taking steps to relocate and do not want to
construct the paving addition due to economic considerations;AND,
WHEREAS,Owner is requesting approval of a temporary accommodation to utilize gravel
surfacing in lieu of hot mix asphalt for a temporary period of time until it can be determined
whether the business mill end up relocating.
NOW,THEREFORE,BK IT RESOLVED by the City Council of the City of Waukee,Iowa
on this 20"'day of October,2014,that the Development Agreement with Ioma Property Partners
LLC is hereby approved to allow for a temporary gravel surface addition for a period of two
years.
