RESOLUTION 14-333
APPROVING A MEMORANDUM OF UNDERSTANDING WITH COMMUNICATIONS
WORIMRS OF AMERICA (CWA),LOCAL ¹7102,AFL-CIO,CLARIFYING LANGUAGE IN
ARTICLE 12,SECTION 5 OF THE JULY 1,2013 —JUNK 30,2016 CONTRACT
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA USE,IOS'A
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,on November 5,2012,the Waukee City Council approved a Collective Bargaining
Agreement with the Conununications Workers of America (CWA),Local ¹7102,AFL-CIO,in effect
July 1,2013 through June 30,2016 (Resolution ¹12-245);AND,
WHEREAS,the City of Waukee and representatives of CWA,Local ¹7102,have reviewed and
approve a Memorandum of Understanding for the current Collective Bargaining Agreement that
clarifies language in Alticle 12,Section 5 within the Agreement to better represent a long-standing
interpretation of said article and section;AND;
WHEREAS,the Memorandum of Understanding is attached hereto and by reference incorporated
herein;
NOW THEREFORE BK IT RESOLVED by the City of Waukee City Council in session this 1"day
of December,2014,that the Memorandum of Understanding with Communications Workers of
America (CWA),Local ¹7102,AFL-CIO,clarifying language in Article 12,Section 5 of the July 1,
2013 —June 30,2016 contract,is hereby approved.

This memorandum modifies the July 1,2013 to June 30,2016,Callective Bargaining Agreement ("CBA")between the
Communication Workers of America,Local 7102,AFL-CIO ("Union")and the City af Waukee,iowa ("City").The purpose of the
memorandum is to acknowledge that the City and the Union have mutually agreed to the following language which better
represents the intent of and both party's long standing interpretation of Article 12,Section S.
Former:
Employees,other than twenty-four (24)hour Fire/EMS employees,who have accrued vacation but not used it during the
anniversary date in which it accrued,shall be permitted to carry over sixty (60)hours of vacation time into the following calendar
year.The sixty (60)hours must be used within the first six (6)months of the year.Upon written request by an employee,the
Department Director and the Employee may agree to extend the deadline to use the carry over vacation hours.
Twenty-four (24)hour Fire/EMS Employees who have accrued vacation but not used it during the anniversary date in which it
accrued shall be permitted to carry over forty-eight (48)hours of vacation time into the following calendar year.The forty-eight (48)
hours must be used within the first six (6)months of the year.Upon written request by an employee,the Department Director and
the Employee may agree to extend the deadline to use the carry over vacation hours.
An Employee may not schedule more than two (2)consecutive weeks of vacation without special permission of the department
head,
