RESOLUTION 14-351
APPROVING THE RELEASE OF PROPERTY FROM DEVELOPER'S AGREEMKNT
AND PETITION CONTRACT AND WAIVER —LOT 7 OF BLUKSTKM PLAT 1
IN THE NAME AND BY THE A UTHOIUTY OF THE CITY OF WA UEEE,
IONIA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Diligent BSP Holdings,LLC ("Developer")signed a certain Developer's
Agreement dated June 11,2013 and recorded July 9,2013 in Book 2013 at Page 12744 (the
"Agreement")and a certain Petition Contract and Waiver dated June 11,2013 and recorded July
9,2013 in Book 2013 at Page 12745 (the "Contract"),all in the office of the Recorder of Dallas
County,Iowa related to obligations associated with the SE LA Grant Parkway street widening
improvements;AND
WHEREAS,Developer has satisfied all obligations and costs allocated and applied against Lot
7 in Bluestem Plat 1,an Official Plat in Waukee,Dallas County,Iowa.Except for the release of
the obligations in relation to Lot 7 of Bluestem Plat 1,the Agreement and Contract remain in full
force and effect and unchanged.
NOW THEREFORE BK IT RESOLVED by the City Council of the City of Waukee,Iowa on
tius the 15'"day of December 2014 that the Release of Property from Developer's Agreement
and Petition Contract and Waiver be approved.
