RESOLUTION 15-091
APPROVING A RELEASE AND SATISFACTION FOR DEVELOPMENT
AGREKMKNT —WILLIAMS POINTE
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF lVA UKEE,IOPVA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized
Mxuucipal Organization;AND,
WHEREAS,Gilcrest Jewett Lumber Company,Williams Pointe Commercial I,LLC and
Williams Pointe Conunercial II,LLC (collectively Property Owners")entered into a
Development Agreement ("Agreement")with the City of Waukee,dated April 25,2006 and
recorded on April 26,2006 in Book 2006 Page 6258,Dallas County,Iowa regarding street
improvements to Alice's Road.
NOW THEREFORE BK IT RESOLVED by the City Council of the City of Waukee,Iowa
that the terms of the Agreement have been fully satisfied and the City releases the Property
Owners and their successors and assigns,from all obligations under said Developers
Agreement.
Passed by the City Council of the City of Waukee,Iowa,and approved tins the 6"day of
April,2015.
