RESOLUTION 15-175
APPROVING THE PARTIAL RELEASE AND SATISFACTION RELATED TO LOT 9
OF PAINTED WOODS PLAT 3
IN THENAMEAND BY THEAUTHORITYOF THE CITY OF WAUKEE,IONA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,A Development Agreement,Petition,Contract and Waiver and Notice Regarding
Sanitary Sewer Lien and Future Special Assessments with the City of Waukee,Iowa,as recorded
on March 30,2007 in Book 2007 at Page 4322 with the Dallas County Recorder's Office which
in Paragraph 4 of said Agreement requires Lot 9 of Painted Woods Plat 3 to be dedicated to the
City for parkland purposes and other obligations as specifically provided in said paragraph;AND
WHEREAS,In consideration of the payment of the sum of $30,600.00 to the City of Waukee,
the City hereby releases Lot 9 of Painted Woods Plat 3,from the obligations provided in
Paragraph 4 of the Development Agreement recorded on March 30,2007 in Book 2007 at Page
4322 with the Dallas County Recorder's Office;AND
WHEREAS,All other provisions of the Development Agreement recorded on March 30,2007
in Book 2007 at Page 4322 with the Dallas County Recorder's Office shall remain in full force
and effect.
NOW THEREFORE BK IT RESOLVED by the City Council of the City of Waukee,Iowa on
this the 1"day of Iune 2015 that the Partial Release and Satisfaction rel d to Lot 9 of Paintd
Woods Plat 3 be approved.
