Revenue for un-metered private lighting shall not be included in any re lund. No refunds shall be made I'or revenue received after six (6)years liom the date of the oidginal advance payment. Never shall the total of refunds exceed the refundable portion of the payment stated above. No refunds shall be made for customers set+cd from a finther extension of the above described electric line extension. A plicant to.be responsible for complying with all aspects of compliance as ppi n required by aiiy local,state,or federal permit or plan associatcrl vvith storm water pollution prevention or erosion control.It is specilically understood and iigreed that lvlhlAmerican Energy Company is providing the service requested by the Applicant solely for thc Applicant.MidAmericall Ellergy Company ivill not become or a&ace to become a co-permittec,or operator for the purpose of applicants'con&pliance with any lociil,state or federal permit or pl'ui associated with storm water pollution prevention or erosion conirol. Applicant shali be responsible for locating and marking all privately otvned systems such as water services,culvmts,inigation systems,drain pipes,septic lilies,r&n(l illlclerglound iviidllg before iMicIAlrieldc&in Energy Colispaliv s construction. It is specifically understood and agreed that any distribution systems,or other facilities constructed or installed by MidAmerican Energy Company under terms of this Proposal shall remain tire sole property of lvlidAmerican Energy Company and lvlidAmerican Energy Company sliall detenmne,as its ov&n judg«nent indicates,thc m&amier and method ol utilization thereof all&1 to extencl the same or connect other facilities there to and serve other customers there fiom as it shall see fit,subject only to such obligations as lvlidAmerican Energy Company shall have assumed in this Proposal:ancl no other person shall have any right,title, interest or claim,in or to the said distribution system or other facilities by virtue of any provision of this Proposal. Applicant shall furnish,install,own and maintain all 4-inch ducts as shown on attached prints.All ducts shall be black vv/rcd stripe or &mcy in color,PVC type schedule 40 or scliedule 40 HDPE coil-able.Applicant.shall install ducts a minimum of forty-two (42)inches and a maximum of forty-eight (48)inches beloiv finish grade with capped and staked ends and equipped with pull wires. MidAmcrican Energy Company will provide marker balls for thc duct ends. These are available at MidAmerican Energy Company&s storeroom.Applicant is responsible for conect placement and depth of condtdt.Note:No more tlian ten (10)conduits allowed vvithin the secondary compartment of the transformer pad.
