RESOLUTION 15-381
APPROVING THE FINAL PLAT FOR CORRECTED FOX CREEK ESTATES PLAT 6
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF 8'A UKEE,IO lYA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,Perfect Acres,LLC,had requested final approval of Fox Creek Estates Plat 6
which was approved by resolution of the City Council on October 19,2015 (Resolution ¹15-371)
and recorded in Dallas County,Iowa in Book 2015 Page 17235;AND,
WHEREAS,an affiliated entity transfer was filed with Dallas County,Iowa that preceded
recording of the Final Plat for Fox Creek Estates Plat 6 which changed title to the property from
Perfect Acres,LLC to Fox Creek Waukee,LLC (Bk 2015 Pg 17133 and Bk 2015 Pg 17134);
AND,
WHEREAS,Fox Creek Waukee,LLC has requested final approval of Corrected Fox Creek
Estates Plat 6 (the "Plat")to replace Fox Creek Estates Plat 6;AND,
WHEREAS,the Final Plat for Corrected Fox Creek Estates Plat 6 and the documents relating
thereto will comply with Section (303 -Land Subdivision Ordinance of the Waukee Municipal
Code.
NOW,THEREFORE,BK IT RESOLVED by the City Council of the City of Waukee,Iowa
on this 9 day of November,2016,that the Final Plat for Corrected Fox Creek Estates Plat 6 be
and the same is hereby accepted and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following
easements and documents to be filed with the Plat:
1.Warranty Deed (Lot A,B,C,D and E);
2.Sanitary Sewer Easement;
3.Public Utility Easement;
4.Storm Water Management Facility Maintenance Covenant;
5.Overland Flowage Easement;
6.Snow Storage Easement;
7.Snow Storage and Sanitary Sewer Easement;
8.Storm Sewer Easement;
9.Storm Sewer and Overland Flowage Easement;
10.Traffic Signal Easement;
11.Temporary Water Main Easement;
12.Temporary Storm Sewer Easement;
13.Landscape Buffer Easement.
