RESOLUTION 15-405
APPROVING THK VACATION OF THE NORTH FIVE FEET OF THE SOUTH TKN
FEET OF A PUBLIC UTILITY EASEMKNT [LOT 9 OF DUPREZ PLACE]
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF 8'A UKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State of Iowa,is a duly organized Municipal
Organization;AND,
WHEREAS,a Public Utility Easement ("Easement")was approved as a part of the final plat for
Duprez Place to allow for the construction of utilities within Lot 9 of Duprez Place;AND,
WHEREAS,it has been determined that the north five feet of the existing Easement does not
contain any existing utilities and no utilities are anticipated to be constructed within this portion
of the Easement;AND,
WHEREAS,the property owner has requested that the easement as described on attached
Exhibit A be vacated.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
7"'day of December,2015,that it hereby approves the vacation of a portion of the Public Utility
Easement within Lot 9 of Duprez Place.
