RESOLUTION 16-027
JOINT FUELING FACILITY 28E AGREEMENT BETWEEN THE CITY OF
WAUKEK AND THE WAUKKE COMMUNITY SCHOOL DISTRICT
IN THE NAMEAND BY THEAUTHORITYOF THE CITY OF WAUKEE,IOIYA
WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas
County;AND,
WHEREAS,the Waukee Community School District is a duly organized school district
within Dallas County;AND,
WHEREAS,the Waukee School District intends on constructing a transportation facility
which will include the construction of a fueling facility;AND,
WHEREAS,the City of Waukee sees a benefit in participation of the construction of the
fueling facility to reduce the overall costs on fuel expenses for City owned vehicles;
AND,
WHEREAS,an agreement pursuant to Iowa Code Chapter 28E is proposed for the
purpose of providing a formalized agreement between the City and the District to fund,
construct and maintain the fueling facility for the use and benefit of both parties;AND,
WHEREAS,the City Attorney has reviewed the proposed 28E Agreement and finds it
satisfactory.
NOW THEREFORE BK IT RESOLVED by the City of Waukee City Council in
session this 18'"day of January,2016,that it hereby approves the 28E Agreement
between the City of Waukee and the Waukee Community School Distric egarding the
construction and operation of a joint fueling facility.
