WAUKEE CITY COUNCIL MINUTES
May 3, 2021
*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom
pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman Pierce (electronically), R. Charles Bottenberg (electronically), Larry R. Lyon
(electronically), Ben Sinclair. Absent: Council Member Chris Crone.
Also in attendance: City Administrator Tim Moerman, Development Services Director Brad
Deets (electronically), Public Works Director/City Engineer Rudy Koester (electronically),
Finance Director Linda Burkhart (electronically), Human Resources Director Michelle Lindsay,
Parks & Recreation Director Matt Jermier (electronically), Marketing & Communications Director
Summer Evans (electronically), IT Director Son Le (electronically), Police Lt. Scott Cunningham,
City Clerk Rebecca D. Schuett, City Attorney Steve Brick (electronically).
(D) Open Forum — Katie Mulara, 276 NW Lexington Dr., proposed the council amend the Triumph
Park Master Plan to include a basketball court, noting that there are no such courts in her
neighborhood and stressing its benefits to the city and for child safety. Mayor Clarke thanked
Ms. Mulara for her comments, stating that the City is continually planning and building new parks
and that one such park is planned for the Stratford Crossing area in 2023.
(E) Agenda Approval — Council Member Lyon moved to approve the agenda; seconded by Council
Member Sinclair. Results of vote: Ayes: Bergman Pierce, Bottenberg, Lyon, Sinclair. Nays:
None. Absent: Crone. Motion carried 4 — 0 — 1.
(F) Monthly Mayor's Report — The Waukee Public Library Summer Reading Challenge is currently
accepting registrations. There continues to be a high demand for water for lawn irrigation and
Waukee residents are encouraged to water on an odd -even schedule. The City issued a record
number of building permits in the first quarter of 2021.
(G) Presentations: None
(H) Public Hearings:
1) On consideration of an annexation moratorium agreement between the City of
Waukee, Iowa, and the City of Adel, Iowa — Mayor Clarke opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Development Services Director Deets noted that an existing annexation
moratorium agreement will expire later this year. The proposed agreement extends the plan
for an additional 10 years. The amendment includes a border change from the current
agreement, which would allow for property owners to annex without splitting properties
between the two cities. The City of Adel will hold their public hearing on the proposed
agreement next week. No comments were made by the public in attendance.
2) On plans, specifications, form of contract and estimate of cost [Little Walnut Creek
North Trunk Sewer Extension Phase 2] — Mayor Clarke opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied in the
negative. Public Works Director/City Engineer Koester reviewed the project, noting that it
was needed to serve future development in that area of the city. The project was included in
the recently approved FY2022 Capital Improvement Plan. No comments were made by the
public in attendance.

Public Hearing Action Items:
1) Resolution: Consideration of approval of a resolution approving a 28E agreement
providing for an annexing moratorium between the Cities of Waukee and Adel —
Council Member Lyon moved to approve the resolution; seconded by Council Member
Bottenberg. Council Member Bottenberg voiced his appreciation that the agreement is part
of a collaborative process with the City of Adel. Results of vote: Ayes: Bergman Pierce,
Bottenberg, Lyon, Sinclair. Nays: None. Absent: Crone. Motion carried 4 — 0 — 1.

2) Little Walnut Creek North Trunk Sewer Extension Phase 2
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost — Council Member Sinclair
moved to approve the resolution; seconded by Council Member Lyon. Results of vote:
Ayes: Bergman Pierce, Bottenberg, Lyon, Sinclair. Nays: None. Absent: Crone. Motion
carried 4 — 0 — 1. (Resolution #2021-160)
B. Resolution: Consideration of approval of a resolution awarding contract — Council
Member Sinclair moved to approve the resolution; seconded by Council Member Lyon.
Public Works Director/City Enigneer Koester reviewed the bid tabulation, noting that the
apparent low bid was approximately 39% over the engineer's estimate. Contractors cited
general decreased capacity, the November 2021 project completion date, certain deep
sections of the sewer extension, and cost of materials as reasons for the higher bids.
Mr. Koester stated that rebidding is not a practical option, as the project is necessary for
development in the area; he recommended awarding contract to low bidder J&K
Contracting, LLC, of Urbandale, IA, in the amount of $1,526,844.00. Council Member
Lyon asked if we would be able to procure the materials once the project was started in
light of skyrocketing material costs; Mr. Koester replied in the affirmative. Council
Member Lyon then asked if the contract price was a set amount; Mr. Koester again
replied in the affirmative but clarified that certain unknown factors may change the final
total project cost. Results of vote: Ayes: Bergman Pierce, Bottenberg, Lyon, Sinclair.
Nays: None. Absent: Crone. Motion carried 4 — 0 — 1. The contract was awarded to
J&K Contracting, LLC, of Urbandale, IA. (Resolution #2021-161)

by Council Member Sinclair. Results of vote: Ayes: Bergman Pierce, Bottenberg, Lyon,

subject area of 20 acres near the Meredith Dr./Warrior Ln. intersection. The property owner
requests a modified land use to allow for an area of commercial development, transitioning
to medium -density residential then single family residential. The request is consistent with
the surrounding development and arterial roadway proximity. A rezoning request will be
presented for council consideration at a future date. Results of vote: Ayes: Bergman Pierce,

Amended Employee Handbook — Council Member Lyon moved to approve the resolution;

for handbook amendments as a result of union decertification. She summarized certain
proposed changes to the handbook, noting that the changes would be effective July 1, 2021.
