WAUKEE CITY COUNCIL MINUTES
June 7, 2021
(A) Call to Order — The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom.
(B) Pledge of Allegiance
(C) Roll Call — The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman Pierce, Chris Crone, Ben Sinclair. Absent: Council Members R. Charles
Bottenberg, Larry R. Lyon.
Also in attendance: City Administrator Tim Moerman, Development Services Director Brad
Deets, Public Works Director/City Engineer Rudy Koester, Finance Director Linda Burkhart,
Human Resources Director Michelle Lindsay, Parks & Recreation Director Matt Jermier,
Marketing & Communications Director Summer Evans, IT Director Son Le, Police Lt. Jeff
Mellencamp, Police Officer Bryan Levsen, City Clerk Rebecca D. Schuett, City Attorney Steve
Brick.

(E) Agenda Approval — Council Member Crone moved to approve the agenda; seconded by
Council Member Bergman Pierce. Results of vote: Ayes: Bergman Pierce, Crone, Sinclair.
Nays: None. Absent: Bottenberg, Lyon. Motion carried 3 — 0 — 2.
(F) Monthly Mayor's Report — Mayor Clarke provided an update on street closures and emergency
detours related to Warrior Ln. improvements. In May, Mayor Clarke and council members took
part in FY2022 goal setting and strategic planning work sessions. The 2021 Celebration of
Independence takes place July 2-4. Within Waukee city limits, fireworks are permitted on July 3
and 4 only. Mayor Clarke noted several recent and upcoming events in the community.

(H) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 and COS to R-2, R-3, R-4 and C-1, a parcel to be
known as Parkside — Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets reviewed the project location and development concept plan, which
includes smaller lots at the northwest corner of the property, then growing in size heading
toward the southeast. He reviewed proposed street alignments, including the extension of
NW 6th St. A culvert connection is planned over the existing drainageway. The green space
is intended as a wetland, passive park with recreational trails. The rezoning application is
consistent with the 2020 Comprehensive Development Plan. No comments were made by
the public in attendance.
2) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from A-1 and COS to R-3/PD-1 and R-4/PD-1, a parcel to be
known as The Courtyards at Parkside — Mayor Clarke opened the public hearing and
asked if any written correspondence had been received; City Clerk Schuett replied that an
email from Ben and Renae Herr, 650 NW Little Walnut Creek Dr., was included in the
meeting packet. Development Services Director Deets reviewed the application, noting that
the R-4 parcel was planned for detached association homes, with the association
maintaining the common ground. It is proposed as an Epcon community, which is reflected
in the proposed PDA overlay. Parkland dedication was incorporated with the parcel to the
north. Mr. Deets cited the Herr email that requested fencing be installed along the property
line; City staff believes that the existing wooded area provides an adequate buffer. Also, a
recreational trail is proposed that would run behind the abutting properties. Council Member
Bergman Pierce noted that when property to the north of the Little Walnut Creek Dr. area
was recently rezoned there was no additional buffering requirement; Mr. Deets replied in the

affirmative, noting that buffering is not required between two areas with the same zoning
classification. Council Member Bergman Pierce stated that while she understood the
request for fencing, the existing topography provided adequate buffering. No comments
were made by the public in attendance.
3) On plans, specifications, form of contract and estimate of cost [Transite Water Main
Replacement Phase 2 Project] — Mayor Clarke opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied in the negative.
Public Works Director/City Engineer Koester reviewed the project and construction budget.
No comments were made by the public in attendance.
Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 and COS to R-
2, R-3, R-4 and C-1, a parcel to be known as Parkside [introduction; first reading] —
Council Member Crone introduced the ordinance and moved to approve the first reading in
title only; seconded by Council Member Sinclair. Results of vote: Ayes: Bergman Pierce,
Crone, Sinclair. Nays: None. Absent: Bottenberg, Lyon. Motion carried 3 — 0 — 2.
2) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning

R-31PD-1 and R-41PD-1, a parcel to be known as The Courtyards at Parkside
[introduction; first reading] — Council Member Sinclair introduced the ordinance and
moved to approve the first reading in title only; seconded by Council Member Bergman
Pierce. Results of vote: Ayes: Bergman Pierce, Crone, Sinclair. Nays: None. Absent:
Bottenberg, Lyon. Motion carried 3 — 0 — 2.
3) Transite Water Main Replacement Phase 2 Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost — Council Member Crone
moved to approve the resolution; seconded by Council Member Sinclair. Council
Member Sinclair asked if there would be any street cuts due to the project calling for
directional boring; Public Works Director/City Engineer Koester replied that some street
cuts were required. Results of vote: Ayes: Bergman Pierce, Crone, Sinclair. Nays:
None. Absent: Bottenberg, Lyon. Motion carried 3 — 0 — 2. (Resolution #2021-210)
B. Resolution: Consideration of approval of a resolution awarding contract — Council
Member Bergman Pierce moved to approve the resolution; seconded by Council
Member Sinclair. Public Works Director/City Engineer Koester reviewed the bid
tabulation, recommending award to Busy Bee Construction, LLC, of Lewistown, MO, in
the amount of $445,134.28. Results of vote: Ayes: Bergman Pierce, Crone, Sinclair.
Nays: None. Absent: Bottenberg, Lyon. Motion carried 3 — 0 — 2. (Resolution #2021-
211)

Resolution: Consideration of approval of a resolution approving preliminary plat for
Castle Ranch Plat 1— Council Member Crone moved to approve the resolution; seconded
by Council Member Sinclair. Development Services Director Deets briefly reviewed the plat,
noting that the concept plan at rezoning consideration included a different number of lots.
However, due to additional development and utility extensions in the area, the plat now
shows 20 lots. The Waukee Fire Department has reviewed and approved the plan for a
single cul-de-sac access for the development. Council Member Sinclair asked about
parkland dedication; Mr. Deets replied that there was no parkland in this particular
development, as it would be very small. Results of vote: Ayes: Bergman Pierce, Crone,

reviewed the provisions within the agreement regarding future Warrior Ln. improvements
and area utilities. The developer also proposes a fee in lieu of parkland dedication. Results

Development Services Director Deets reviewed the agreement, which addresses the
extension of utilities through the property to service development to the north. Council
Member Bergman Pierce asked if the utilities would make the Brcka parcel easier to develop
in the future; Mr. Deets replied in the affirmative. Results of vote: Ayes: Bergman Pierce,

pay grade [Assistant City Administrator] — Council Member Bergman Pierce moved to
approve the resolution; seconded by Council Member Sinclair. City Administrator Moerman
reviewed the role of the proposed position and announced that, pending council approval of
the resolution, he would appoint Development Services Director Deets to the position. Mr.
Deets addressed the council to review an initial work program for the position. Results of
