RESOLUTION 16-230
APPROVING PUBLIC HIGHWAY AT-GRADE CROSSING AGREEMENT [98
STREET/WACO PLACE IMPROVEMENTS PROJECT]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Iowa is a duly organized municipality within Dallas County;
AND,
WHEREAS,on May 16,2016,the City of Waukee approved entering into a 28E agreement
with the City of West Des Moines related to a public improvement project known as the 98'"
Street/Waco Place Improvements Project (Resolution ¹16-187);AND,
WHEREAS,part of the Project includes paving improvements to the Union Pacific Railroad
Company crossing;AND,
WHEREAS,the Union Pacific Railroad Company has provided an agreement related to the
right to construct an at-grade crossing of the rail line;AND,
WHEREAS,the Cities of Waukee and West Des Moines shall share equally in the costs
associated with the at-grade crossing improvements;AND,
WHEREAS,the City Attorney has reviewed the agreement and finds it satisfactory.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
6'day of June,2016,that it hereby approves a Public Highway At-Grade Crossing Agreement
[98 'Street/Waco Place Improvements Project].
