HomeMy WebLinkAbout2021-01-18-I01X Broderick Property Rezoning_Set PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: January 18, 2021 AGENDA ITEM: Consideration of approval of a Motion to set a Public Hearing Date of February 16, 2021, as the date of public hearing on an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 Agricultural District to R-4 Row Dwelling & Townhome District [Broderick Property] FORMAT: Motion SYNOPSIS INCLUDING PRO & CON: Staff has received a request for rezoning of approximately 19.74 acres of property from A-1 to R-4. The property is located east of the new high school and north of Hickman Road. In order to set a public hearing to discuss a rezoning, the applicant is required to receive written consent from 50% of the surrounding property owners within a 250-foot radius of the property. Alternatively, the City Council can set a public hearing date on behalf of the applicant. The applicant has indicated that they have been unsuccessful in receiving the 50% consent from surrounding property owners. There are five property owners within the 250-foot radius surrounding the subject property. Two owners provided consent for a total of 20.04% consent. The City of Waukee and the Waukee Community School District are two of the property owners within the 250-foot radius, however, neither party is eligible to provide consent. The remaining property owner was contacted by the applicant; however, the applicant received no response. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the City Council setting the public hearing date for February 16, 2021 to discuss this matter further. Council action to set the public hearing date does not indicate support for the project. Rather, it represents the Council’s willingness to allow the public hearing process to continue. RECOMMENDATION: Approve the motion. ATTACHMENTS: I.
