HomeMy WebLinkAbout2021-02-01-H02 Lolowau Love Rezoning_PH AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: February 1, 2021 AGENDA ITEM: Public hearing on an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 Agricultural District, R-2 One and Two Family Residential District and C-1 Community and Highway Service Commercial District to K-MF Row Kettlestone Multi-Family Rowhouse District, K-MF Med Kettlestone Multi-Family Stacked Medium District, K-MF High Kettlestone Multi-Family Stacked High District, K-RC Kettlestone Retail Community District, K-OF Kettlestone Office District and COS Conservation and Open Space District [Lolowau Love Properties] FORMAT: Public Hearing SYNOPSIS INCLUDING PRO & CON: Staff has received a request for rezoning of approximately 97.81 acres of property from a combination of A-1, R-2 and C-1 to various zoning districts associated with development within the Kettlestone defined area. The property is located west of Grand Prairie Parkway and extends from Tallgrass Lane at the south end up to the extension of Prairie Park Lane. Notices were mailed to surrounding property owners on January 14, 2021 and rezoning signs were placed at various locations along the property with the Planning and Zoning Commission and City Council public hearing dates. To date, staff has not received any correspondence either for or against the proposed rezoning request. After an extensive master planning process, the City Council approved the Kettlestone Master Plan in 2014 followed by the Kettlestone Design Guidelines and Kettlestone Zoning Districts in 2015. The proposed rezoning request generally follows the recommendations of the Kettlestone Master Plan and includes rezoning for approximately four acres of townhomes, five acres of medium density multi-family, ten acres of high density multi-family, forty four acres of retail commercial, thirty two acres of office and four acres of conservation and open space. As a part of the rezoning application, the applicant provided a concept plan which provides a general depiction of how the property could develop based upon the proposed rezoning request. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning Commission reviewed the rezoning request on January 26, 2021 and recommended approval: H2 Approval of a Rezoning related to a change from A-1 (Agricultural District), R-2 (One and Two Family Residential District), and C-1 (Community and Highway Service Commercial District) to K-MF (Row Kettlestone Multi-Family Rowhouse District), K-MF (Med Kettlestone Multi-Family Stacked Medium District), K-RC (Kettlestone Retail Community District), K-OF (Kettlestone Office District), and COS (Conservation and Open Space District) [Lolowau Love Properties] Director of Development, Brad Deets, introduced the request for rezoning as submitted by the applicant Lolowau, LLC. The subject property is generally located west of Grand Prairie Parkway and south of SE Prairie Park Lane, containing approximately 97.81 acres. This area is part of the Kettlestone Corridor and the current zoning on the property pre-dates the Kettlestone Master Plan and the extension of Grand Prairie Parkway. Notice was sent out and placed on the property January 14th, 2021. There have been no comments for or against the rezoning, only informational requests. Mr. Deets advised that the applicant has submitted a request to rezone the property as follows: approximately 4 acres for Kettlestone Rowhouse district, 5 acres for Kettlestone Multi-Family medium density district, 10 acres for Kettlestone Multi-Family high density district, 44 acres for Kettlestone retail community district, 32 acres for Kettlestone office district, and 4 acres for conservation and open space district. These changes are all consistent with the Kettlestone Master Plan. Mr. Deets explained that the conceptual plan for the development is possible but not the finalized plan as specific projects will need to come to the City for consideration and site plan approval. The request tonight is for the zoning and use of the sites. In addition to the potential site lay out, the conceptual plan includes conservation and open space in areas that follow the proposed public trail system that will be developed over time between the commercial and residential developments as extensions of that trail. At this time staff would recommend approval of the rezoning, with platting and site plan approval required prior to any individual development within the property.  Commissioner Hoifeldt questioned what the long term use was for the southwest adjacent property between the subject property and street. Mr. Deets advised that the land is owned by ARAC, LLC and there is a possibility for staff to see a rezoning request as there is space for several different development possibilities on the property.  Commissioner Hoifeldt questioned what the zoning is on the property to the north at the east corner. Mr. Deets advised that the zoning is additional commercial ground. There would be more property needed in order for any project to develop in this particular corner.  Commissioner Broderick questioned if there had been any response from surrounding owners. Mr. Deets advised there was one call for further explanation of the request, but no statements for or against the rezoning.  Commissioner Hoifeldt moved to approve the rezoning from A-1 ( Agricultural District) , R-2 ( One and Two Family Residential District), and C-1 (Community and Highway Service Commercial District) to K-MF (Row Kettlestone Multi-Family Rowhouse District), K-MF (Med Kettlestone Multi-Family Stacked Medium District), K-RC (Kettlestone Retail Community District), K-OF (Kettlestone Office District), and COS (Conservation and Open Space District), subject to any remaining staff comments and review of legal documents. Commissioner Inman seconded the motion. Ayes: Inman, Conley, Broderick, Ward, and Hoifeldt. Nays: None. Motion Carries. STAFF REVIEW AND COMMENT: Staff believes the proposed rezoning request is consistent with the previous planning efforts that have been undertaken within the overall Kettlestone defined area and would recommend approval of the rezoning request. Location and Size: Property is generally located west of Grand Priaire Parkway, north of SE Tallgrass Lane and south of SE Prairie Park Lane (extended) containing approximately 97.81 acres. BACKGROUND The subject property is located within the Kettlestone Corridor and includes approximately 98 acres of property that is generally located west of Grand Prairie Parkway. There is a small parcel of the property in the northeast corner that is located east of Grand Prairie Parkway. The majority of the property that is located north of SE Westown Parkway has an existing zoning of C-1 Community and Highway Commercial District, which allows for most commercial type uses. The property located south of Westown Parkway is zoned A-1 Agricultural District. There is a small parcel (approximately 3.2 acres) at the intersection of SE Westown Parkway and SE Parkview Crossing Drive that is zoned R-2 One and Two Family Residential District. All of the existing zoning on the property predates the completion of the Kettlestone Master Plan and the extension of Grand Prairie Parkway. As a part of the planning and construction of Grand Prairie P arkway, the City invested in the development of the Kettlestone Master Plan to provide a tool for development of the property adjoining both east and west of of Grand Prairie Parkway from Interstate 80 to University Avenue. This planning document has been utilized as a guide for the rezoning of various properties over the last five years that adjoin Grand Prairie Parkway. As a part of the master plan process, the City also adopted new zoning districts which were specific for January 22, 2021 2 of 5 properties located within the Kettlestone Master Plan. Comprehensive design standards were also adopted which detail building placement, parking lot location, building design and architecture, access management and open space components among other things. The applicant has submitted a rezoning request that includes approximately 4 acres proposed to be rezoned to the Kettlestone Rowhouse (townhome) district, 5 acres proposed to be rezoned to the Kettlestone Multi- Family medium density district, 10 acres proposed to be rezoned to the Kettlestone Multi-Family high density district, 44 acres proposed to be rezoned to the Kettlestone retail community district, 32 acres proposed to be rezoned to the Kettlestone office district and 4 acres proposed to be rezoned to the conservation and open space district. The proposed rezoning request is generally consistent with the Kettlestone Master Plan. Notice regarding the rezoning request was mailed to the surrounding property owners on January 14, 2021. Additionally, signs regarding the rezoning date and time for Planning and Zoning Commission and City Council have been placed at various locations where the property adjoins public streets. In general, the proposed medium and high density residential uses are located along the western portion of the property and provide separation from the existing single family homes and townhomes that are located further to the west. The proposed commercial office uses are located throughout the property with the majority of the commercial uses fronting Grand Prairie Parkway and SE Westown Parkway. While it is possible the overall site could develop in this fashion, this is not a finalized plan and as specific projects come to the City for consideration January 22, 2021 3 of 5 for site plan approval, the configuration and layout of lots and buildings may change, however, if approved, the proposed zoning and use of those buildings/sites will not change. As a part of the original construction of Grand Prairie Parkway, the large pond located north of SE Westown Parkway was constructed and is owned and maintained by the City. In addition to it being an amenity for the general public, it will also function for purposes of storm water management for the majority of the development located between SE Prairie Park Lane and SE Westown Parkway. Storm water detention will still need to be provided as a part of the development of the property located south of SE Westown Parkway. While not shown on the proposed concept plan, it is possible that as further development of the property occurs, that a smaller regional retention pond, much like is shown to the north, is developed to serve the remaining areas of the development. Alternatively, individual sites will be responsible for their own storm water management as each site develops. As a part of the rezoning request, there are two areas that are being identified to be preserved long term for conservation and open space. In general, these areas follow the proposed public trail system that will be developed over time that will meander between the commercial and residential developments. The City will be finishing up a trail project later this year which extends from SE Tallgrass Lane and connects into SE Parkview Crossing Drive just to the west of the large pond. The proposed rezoning boundaries as shown in the image above on the right in general follow the recommended land uses of having higher density residential buffer the lower density residential already in place with office uses in the middle and more intense commercial uses along Grand Prairie Parkway. The proposed rezoning request differs in that there is more commercial uses shown in exchange for less office. Additionally, while the land use plan called for more higher density multi-family residential south of SE Westown Parkway, the proposed rezoning request shows a lower density multi-family use at the southwest corner of the property. January 22, 2021 5 of 5 STAFF RECOMMENDATION The proposed rezoning request is generally consistent with the approved Kettlestone Master Plan and Kettlestone Design Guidelines and staff would recommend approval.
