SYNOPSIS INCLUDING PRO & CON: The Amended Public Utility Easement is necessary for
the construction of the Warrior Lane Improvements Phase 1 Project.
MidAmerican Energy requested an amendment to the previously approved
amended public utility easement to address language they felt didn’t allow
City franchised utilities to occupy the easement. This was not the intent and
therefore this amended easement will correct this error. City legal staff have
reviewed and approved the second amendment.

RESOLUTION 2021-
APPROVING AMENDED PUBLIC UTILITY EASEMENT FOR THE WARRIOR
LANE IMPROVEMENTS PHASE 1 PROJECT [IMMANUEL LUTHERAN
CHURCH]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on April 6, 2020, the Waukee City Council approved a Public Utility Easement on
property owned by the Immanuel Lutheran Church for the purpose of construction of the
Waukee Public Library Stormwater Improvements Project (Resolution #2020-122); AND,
WHEREAS, on August 3, 2020, the Waukee City Council approved an amendment to the
Public Utility Easement after staff discovered an error in the Public Utility Easement (Resolution
#2020-281) AND,
WHEREAS, a second amendment is proposed to correct specific language related to franchise
utilities in the Public Utility Easement.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
1st day of February, 2021, that it hereby approves the Amended Public Utility Easement for the
Warrior Lane Improvements Phase 1 Project [Immanuel Lutheran Church].
