HomeMy WebLinkAbout2021-02-01-J03 Utility Permit Application Fee Ordinance_INTRO, 1ST-3RD READAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: February 1, 2021 AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 225, Utility Permit Application, by amending Section 225.2(D), Issuance [Introduction; first, second, third (final) readings] FORMAT:Ordinance SYNOPSIS INCLUDING PRO & CON: City staff recently discovered that the utility permit application fee noted in Chapter 225 of Waukee Municipal Code had not been updated to match that same fee as noted in the Fee Schedule approved via resolution. The ordinance amendment will allow the City Council to approve rates for utility permits via resolution rather than through ordinance. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: In order to enact newly proposed rates by resolution, City staff recommends approval of the first reading of the ordinance in title only and waiver of the second and third readings. The Code of Iowa requires a vote of not less than three-fourths of all the members of the council (or 4 out of 5, in Waukee’s case) in order to waive readings of an ordinance. RECOMMENDATION: Introduce the ordinance, approve the first reading in title only, waive the second and third readings and place the ordinance on final passage. ATTACHMENTS: I. AN ORDINANCE TO AMEND CHAPTER 225, UTILITY PERMIT APPLICATION, BY AMENDING SECTION 225.2(D), ISSUANCE WHEREAS, the City of Waukee has determined that the permit fee associated with a Utility Permit Application, as defined in Chapter 225, Waukee Municipal Code, shall be set by resolution. BE IT THEREFORE ORDAINED by the City Council of the City of Waukee: Section 1: Chapter 225, Waukee Municipal Code, Section 225.2(D) should be and the same is hereby amended as follows: Issuance. Upon approval of the application, the Utility Permit will be issued by the City. The permit fee shall be set by resolution of the city council. Section 2. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provisions or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect upon its final passage, approval and publication as provided by law.
