HomeMy WebLinkAbout2021-02-16-I01B 02012021_02082021_minutesWAUKEE CITY COUNCIL MINUTES February 1, 2021 *Due to public health concerns and guidance, in accordance with Iowa Code Sections 21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as holding the meeting in person was impossible or impractical. (A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8. (B) Pledge of Allegiance (temporarily suspended) (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna Bergman (electronically), R. Charles Bottenberg (electronically), Chris Crone, Larry R. Lyon (electronically), Ben Sinclair. Absent: None. Also in attendance: City Administrator Tim Moerman, Development Services Director Brad Deets (electronically), Public Works Director/City Engineer Rudy Koester (electronically), Finance Director Linda Burkhart (electronically), Human Resources Director Michelle Lindsay (electronically), Marketing & Communications Director Summer Evans (electronically), IT Director Son Le (electronically), Police Lt. Jeremy Long, City Clerk Rebecca D. Schuett, City Attorney Steve Brick (electronically). (D) Open Forum (E) Agenda Approval – Council Member Crone moved to approve the agenda; seconded by Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (F) Monthly Mayor’s Report – Mayor Clarke noted recent virtual meetings with Waukee Area Christian Services and Dallas County Local Housing Trust Fund regarding the status of evictions and the need for local rental assistance. She then reviewed several relief programs available to businesses as a result of the COVID-19 pandemic. The outdoor ice rink is open when weather permits. Mayor Clarke thanked Waukee crews for their hard work following a recent winter storm. (G) Presentations: None (H) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-1/PD-1, a property to be known as Timber Creek Plat 1 – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the rezoning application, noting that the property has an existing home and outbuilding that are planned to remain. The PD-1 zoning allows the developer to keep the outbuilding for personal but not commercial use. The development is planned as a gated community; as such, the PD also specifically addresses emergency vehicle access and road construction specifications. Korey Marsh with Snyder & Associates, participating electronically and representing the applicant, introduced himself if there were any questions. Council Member Bottenberg asked if Waukee had any other gated communities; Mr. Deets replied in the negative, adding that there are some single occupant properties with similar limited access. No comments were made by the public in attendance. 2) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1, R-2 and C-1 to K-MF Rowhouse, K-MF-Stacked Med, K-MF-Stacked High, K-RC, K-OF and COS, a property known as Lolowau Love Properties – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets reviewed the rezoning application, which is consistent with the I1B 2 Kettlestone comprehensive development plan. The applicant has provided a development concept plan. Mayor Clarke asked for public comment: 1) Josh Helvig, 1860 SE Waters Edge Dr. (participating electronically), asked what was planned as tenants for the retail areas, requested clarification on lighting, and wondered what brought about the rezoning application. Mr. Deets responded that the majority of the property north of Westown Pkwy. was already zoned commercially, then reviewed some of the allowable uses. Lighting regulations include setbacks and buffering requirements. Mr. Helvig then asked about commercial hours of operation for businesses on the northern part of the development; Mayor Clarke speculated that businesses nearer residential areas would likely have more standard business hours. Mr. Helvig wondered about the height of buildings in the townhome development areas, as well as lighting; Mayor Clarke clarified that the current public hearing was only for rezoning and that those specifics would be considered by council at a later date during platting and site planning. 2) Kristina Johnson, 2445 SE Sawyer Pt. (participating electronically), stated that prior to building her home, her realtor said that the property behind their home would be developed as retail/office, not as the proposed multi- family development. She expressed concern that multi-family development would lower area property values and change the character of the neighborhood. Mr. Deets noted that the Kettlestone comprehensive development plan identified the area in question as multi- family since 2014 and that retail/office development has never been intended that far west. Ms. Johnson then voiced her concern about lighting and asked for clarification on the proposed medium-density multi-family area; Mr. Deets noted that the area in question would be developed more as duplex units. Mayor Clarke added that the City generally plans multi- family development as a buffer between single family and commercial areas. Council Member Crone noted that the Council welcomed comments but reiterated that only the zoning application was currently being considered. Devon Blosch with Confluence, participating electronically and representing the developer, clarified that what is being presented is only a hypothetical development plan and that there are yet no plans for specific users. 3) Kristi Krumm, 2465 SE Sawyer Pt. (participating electronically), reiterated Ms. Johnson’s comments regarding property values and the character of the area, adding her concerns that multi-family development allowed those residents to watch children at play in the neighborhood. 3) On an FY2022 proposed property tax levy pursuant to Iowa Code 384.15A – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Finance Director Burkhart noted that the public hearing was required as the City plans to exceed 102% growth in the upcoming fiscal year. There is no plan to raise property taxes for FY2022. She added that the hearing notice was posted on all City online outlets as required and that no comments were received pertaining to the levy. Mayor Clarke asked for public comment: 1) Ron Marr, 2935 SE Timberline Dr. (participating electronically), stated that the proposed tax levy was appreciated, but that in the current weak economy, the City could send a message to residents by lowering the levy an additional $0.05. He added that he understood the need for the proposed utility billing increases, but reiterated that the City could find money in the budget to lower the tax levy. Mayor Clarke replied that the City did look at the possibility of lowering tax rates in the upcoming fiscal year, but that there are currently too many unknowns at the state level. She added that lower property taxes were a priority last year and would again be considered next year. 4) On the issuance of Not to Exceed $9,500,000 General Obligation Bonds – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Finance Director Burkhart reviewed the proposed bond issuance, noting that the hearing addresses bonds that the City plans to sell in both March and September 2021. The proposal also includes refunding options for existing bonds. No comments were made by the public in attendance. 5) On the issuance of Not to Exceed $35,000,000 General Obligation Urban Renewal Bonds – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Finance Director Burkhart 3 reviewed the proposed bond issuance, noting that the funding was for capital improvement projects in urban renewal areas. The hearing addresses bonds that the City plans to sell in both March and September 2021. No comments were made by the public in attendance. (I) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1 to R-1/PD-1, a property to be known as Timber Creek Plat 1 [introduction; first reading] – Council Member Crone introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. 2) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by rezoning certain property from A-1, R-2 and C-1 to K-MF Rowhouse, K-MF-Stacked Med, K-MF-Stacked High, K-RC, K-OF and COS, a property known as Lolowau Love Properties [introduction; first reading]– Council Member Sinclair introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Crone. Development Services Director Deets stated that the comments made during the public hearing were appreciated, then pointed out that Parkview Crossing Dr. is designed as a major collector street and that based on location and visibility, commercial development would likely be limited as being too far removed from Grand Prairie Pkwy. He reiterated that the Kettlestone comprehensive development plan shows zoning similar to what has been proposed, adding that the multi-family areas would actually have lower density than would typically be allowed. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. 3) Resolution: Consideration of approval of a resolution approving FY2022 maximum property tax dollars – Council Member Crone moved to approve the resolution; seconded by Council Member Sinclair. Finance Director Burkhart noted that the resolution required a 2/3 majority vote of the council for approval. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2021-037) 4) Resolution: Consideration of approval of a resolution instituting proceedings to take additional action for the issuance of Not to Exceed $9,500,000 General Obligation Bonds – Council Member Crone moved to approve the resolution; seconded by Council Member Sinclair. Council Member Bottenberg stated that he would abstain from voting due to a professional conflict of interest. Results of vote: Ayes: Bergman, Crone, Lyon, Sinclair. Nays: None. Absentions: Bottenberg. Motion carried 4 – 0 – 1.
